1 મુખ્ય ન્યાયાધીશ રંજન ગોગોઈ - સર્વોચ્ચ અદાલતના મુખ્ય ન્યાયાધીશ રંજન ગોગોઈ 17 નવેમ્બરે નિવૃત્ત થાય એ પહેલાં મહત્ત્વના ઘણા કેસમાં ચુકાદા આપવાના છે. ગોગોઈએ તેમના કાર્યકાળ દરમિયાન સીમાચિહ્નરૂપ ઘણા ચુકાદા આપ્યા છે, જેમાં બોલીવૂડના મહારથી અમિતાભ બચ્ચનના કર આકારણી કેસ અને આસામના નેશનલ રજિસ્ટર ઓફ સિટિઝન્સ (એનઆરસી) કેસનો સમાવેશ થાય છે.
એનઆરસીને મહત્ત્વનું ગણાવવા ઉપરાંત એક પરિસંવાદમાં તેમણે તેને 'ભાવિનો દસ્તાવેજ' ગણાવ્યું હતું. અમિતાભ બચ્ચનને લોકપ્રિય ટીવી ક્વિઝ શોમાંથી થયેલી આવકની પુનઃઆકારણીની સત્તા ઇન્કમટૅક્સ કમિશનર પાસેથી આંચકી લેતા બોમ્બે હાઈકોર્ટના 2012ના ચુકાદાને ન્યાયાધીશ ગોગોઈ તથા ન્યાયાધીશ પ્રફુલ્લ સી. પંતની બનેલી ખંડપીઠે મે, 2016માં રદ્દ કર્યો હતો.
જવાહરલાલ નહેરુ યુનિવર્સિટી(જેએનયુ)ના વિદ્યાર્થી સંઘના નેતા કનૈયા કુમારને રાજદ્રોહના એક કેસ સંબંધે દિલ્હીની પટિયાલા હાઉસ કોર્ટમાં 2016ની 15 તથા 17 ફેબ્રુઆરીએ લાવવામાં આવી રહ્યા હતા ત્યારે તેમના પર કરવામાં આવેલા હુમલાની તપાસ ખાસ તપાસ ટુકડી (એસઆઈટી) મારફત કરાવવાની માગણી કરતી સિનિયર વકીલ કામિની જયસ્વાલની અરજીને પણ ગોગોઈએ 2018માં એક સિનિયર જજ તરીકે ફગાવી દીધી હતી.
'જાહેર હિતની અને અન્ય ફાલતુ અરજીઓને' ધ્યાનમાં ન લેવાની બાબતમાં પણ ગોગોઈએ ચાવીરૂપ ભૂમિકા ભજવી છે. આ પ્રકારની અરજીઓ કરીને અદાલતનો સમય બગાડવા બદલ તેમણે ઘણીવાર અરજદારોને ભારે દંડ પણ ફટકાર્યો હતો. જોકે, ગોગોઈના મુખ્ય ન્યાયધીશ તરીકેના કાર્યકાળ દરમિયાન એક મહિલાએ તેમના પર કરેલા આક્ષેપને કારણે વિવાદ સર્જાયો હતો. એ મુદ્દાને સુપ્રીમ કોર્ટે બાદમાં 'ખોટો' ગણાવીને ફગાવી દીધો હતો.
2 દેશના પદનામિત મુખ્ય ન્યાયાધીશ શરદ અરવિંદ બોબડે - રંજન ગોગોઈ નિવૃત્ત થયા બાદ સર્વોચ્ચ અદાલતના મુખ્ય ન્યાયાધીશનું પદ સંભાળનારા શરદ અરવિંદ બોબડે પણ તેમણે આપેલા અનેક મહત્ત્વના ચુકાદાઓ માટે જાણીતા છે, જેમાં દિલ્હીના પ્રદૂષણ સંબંધી ચુકાદાનો સમાવેશ થાય છે. તેમને મધ્યપ્રદેશ હાઈકોર્ટમાંથી એપ્રિલ-2013માં પ્રમોશન આપવામાં આવ્યું હતું અને તેઓ એપ્રિલ-2021 સુધી મુખ્ય ન્યાયાધીશ તરીકે કાર્યરત રહેશે. તેઓ મહારાષ્ટ્રના ભૂતપૂર્વ ઍડવોકેટ જનરલ અરવિંદ બોબડેના પુત્ર છે અને તેમણે બોમ્બે હાઈકોર્ટમાંથી કારકિર્દી શરૂ કરી હતી. તેમણે હાઈકોર્ટ અને સુપ્રીમ કોર્ટમાં 21થી વધુ વર્ષ સુધી પ્રેકટિસ કરી છે. વર્ષ 2000માં શરદ અરવિંદ બોબડેની નિમણૂક બોમ્બે હાઈકોર્ટના એડિશનલ જજ તરીકે કરવામાં આવી હતી અને ઓક્ટોબર, 2012માં તેમની નિમણૂક મધ્ય પ્રદેશ હાઈકોર્ટના મુખ્ય ન્યાયાધીશ તરીકે કરવામાં આવી હતી. તેઓ દેશના 47માં મુખ્ય ન્યાયાધીશ બનશે. તેમણે આપેલા મહત્ત્વના ચુકાદાઓ પૈકીનો એક જોગેન્દ્ર સિંહ વિરુદ્ધ મધ્ય પ્રદેશ સરકારનો છે.
એ કેસમાં ત્રણ ન્યાયમૂર્તિઓની એક ખંડપીઠે મૃત્યુદંડની સજાને આજીવન કારાવાસની સજામાં પરિવર્તિત કરી હતી. મધ્ય પ્રદેશ હાઈકોર્ટે એક મહિલાની હત્યા કરવા બદલ એક આરોપીને મૃત્યુદંડની સજા કરી હતી. આરોપીને એક અન્ય કેસમાં જામીન પર છોડવામાં આવ્યો હતો ત્યારે તેણે મહિલાની હત્યા કરી હતી.
એ કેસમાં ન્યાયમૂર્તિ બોબડેએ ઠરાવ્યું હતું કે સંયોગોને ધ્યાનમાં લેતાં આ કેસને 'અત્યંત વિશિષ્ઠ' સજાને પાત્ર ગણી શકાય નહીં. 'પ્રાઈવસીના અધિકારને મૂળભૂત અધિકાર ગણાવતો નિર્ણય' બોબડે પ્રાઈવસીના અધિકારનું સમર્થન કરતી નવ સભ્યોની બંધારણીય ખંડપીઠના પણ સભ્ય હતા.
2017નો એ બહુચર્ચિત કેસ કે. એસ. પુટ્ટાસ્વામી વિરુદ્ધ ભારત સરકારનો હતો. પ્રાઈવસીના અધિકારને મૂળભૂત અધિકાર ગણાવતો આગવો અભિપ્રાય ન્યાયમૂર્તિ બોબડેએ આપ્યો હતો. તેમણે જણાવ્યું હતું કે આધાર યોજના વ્યક્તિની પ્રાઇવસીને મર્યાદિત કરે છે. તેમણે એવું પણ નોંધ્યું હતું કે કોઈ નાગરિક પાસે આધાર નંબર ન હોય તો તેને સરકારી સબસિડીથી વંચિત રાખી શકાય નહીં. ન્યાયમૂર્તિ બોબડે જેના સભ્ય હતા એ સાત સભ્યોની બંધારણીય ખંડપીઠે સીમાચિહ્નરૂપ એક અન્ય ચુકાદો પણ આપ્યો હતો. ન્યાયમૂર્તે બોબડેએ તત્કાલીન મુખ્ય ન્યાયાધીશ ટી. એસ. ઠાકુર અને ન્યાયમૂર્તિ અર્જન કુમાર સિકરી સાથે મળીને દિલ્હીમાં ફટાકડાના વેચાણ તથા સંગ્રહ પર પ્રતિબંધ લાદતો ચુકાદો આપ્યો હતો.

3 . ન્યાયમૂર્તિ ડી. વાય ચંદ્રચૂડ - ન્યાયમૂર્તિ ધનંજય યશવંત ચંદ્રચૂડ પણ તેમના સિમાચિહ્નરૂપ ચુકાદાઓ માટે વિખ્યાત છે. એ પૈકીના એક ચુકાદામાં તેમણે તેમના પિતાએ 1985માં આપેલા ચુકાદાને ઉલટાવતા ચુકાદાનો સમાવેશ થાય છે. ડી. વાય. ચંદ્રચૂડ સૌથી લાંબા સમય સુધી દેશના મુખ્ય ન્યાયાધીશ તરીકે ફરજ બજાવી ચૂકેલા ન્યાયમૂર્તિ વાય. વી. ચંદ્રચૂડના પુત્ર છે.
એડલ્ટરી એટલે કે વ્યભિચાર સંબંધી કાયદો બંધારણીય રીતે માન્ય છે તેવો ચુકાદો વાય. વી. ચંદ્રચૂડે આપ્યો હતો, પરંતુ વર્ષો વિત્યાં બાદ તેમના પુત્ર ડી. વાય. ચંદ્રચૂડે એવો ચુકાદો આપ્યો હતો કે એ કાયદાની કલમક્રમાંક 497 મહિલાની ગરિમા અને આત્મસન્માનને વાસ્તવમાં ખતમ કરી નાખે છે. તેમણે નોંધ્યું હતું કે મહિલાને તેના પતિની માલિકીની ચીજવસ્તુ ગણી શકાય નહીં અને પ્રસ્તુત કાયદો તેમના જાતીય સ્વાતંત્ર્યનું ઉલ્લંઘન કરે છે. ન્યાયમૂર્તિ ડી. વાય. ચંદ્રચૂડે દિલ્હી યુનિવર્સિટીમાંથી એલએલબીની ડિગ્રી મેળવ્યા બાદ કાયદામાં માસ્ટર્સની ડિગ્રી પ્રાપ્ત કરી હતી. 2016માં તેમની નિમણૂંક સુપ્રીમ કોર્ટમાં એક જજ તરીકે કરવામાં આવી હતી. તેઓ 2024 સુધી ન્યાયમૂર્તિપદ પર કાર્યરત રહેશે.
4 ન્યાયમૂર્તિ અશોક ભૂષણ - ઉત્તર પ્રદેશના જૌનપુરના વતની ન્યાયમૂર્તિ અશોક ભૂષણને 2016માં બઢતી આપીને સર્વોચ્ચ અદાલતમાં લાવવામાં આવ્યા હતા. તેઓ 2021માં નિવૃત્ત થશે. 2001માં તેમની નિમણૂક અલાહાબાદ હાઈકોર્ટના કાયમી ન્યાયમૂર્તિ તરીકે કરવામાં આવી હતી. 2015માં તેમને કેરળ હાઈકોર્ટના મુખ્ય ન્યાયાધીશ બનાવવામાં આવ્યા હતા.
આધારને પાન કાર્ડ સાથે ફરજિયાત જોડવાના આદેશ પર આંશિક પ્રતિબંધ લાદી ચૂકેલી ખંડપીઠમાં ન્યાયમૂર્તિ અર્જુન સિકરીની સાથે ન્યાયમૂર્તિ અશોક ભૂષણ પણ હતા. કેરળ હાઈકોર્ટમાં તેમની એક ખંડપીઠે એવો ચુકાદો આપ્યો હતો કે એફઆઈઆરને આરટીઆઈ ઍક્ટમાંથી મુક્તિ આપવામાં આવી છે એવો આદેશ સંબંધિત સત્તાવાળાઓ ન આપે ત્યાં સુધી પોલીસે આરટીઆઈ હેઠળ દરેક એફઆઈઆરની કૉપી પૂરી પાડવાની રહેશે.
5. ન્યાયમૂર્તિ અબ્દુલ નઝીર - કર્ણાટક હાઈકોર્ટમાંથી પ્રમોશન મેળવીને ફેબ્રુઆરી, 2017માં સુપ્રીમ કોર્ટમાં લાવવામાં આવેલા ન્યાયમૂર્તિ અબ્દુલ નઝીર જાન્યુઆરી, 2023માં નિવૃત્ત થવાના છે. સુપ્રીમ કોર્ટમાં બઢતી પામ્યા એ પહેલાં તેમણે દેશની એકેય હાઈકોર્ટમાં મુખ્ય ન્યાયાધીશ તરીકે ફરજ બજાવી નથી. મેંગલોરના વતની ન્યાયમૂર્તિ અબ્દુલ નઝીરે કર્ણાટક હાઈકોર્ટમાં લગભગ 20 વર્ષ સુધી વકીલાત કરી હતી અને 2003માં તેમની નિમણૂક હાઈકોર્ટના એડિશનલ જજ તરીકે કરવામાં આવી હતી. તેઓ અયોધ્યા ટાઇટલ ડિસ્પ્યુટ કેસની સુનાવણી કરી રહેલી સુપ્રીમ કોર્ટની ત્રણ ન્યાયમૂર્તિઓની ખંડપીઠના સભ્ય હતા.
પ્રસ્તુત મેટરની સુનાવણી મોટી બંધારણીય ખંડપીઠે કરવી જોઈએ તેવો આગ્રહ ન્યાયમૂર્તિ અબ્દુલ નઝીરે રાખ્યો હતો. તેઓ ટ્રિપલ તલાકની બંધારણીય યોગ્યતાનો નિર્ણય કરી ચૂકેલી ખંડપીઠના પણ સભ્ય હતા.
તત્કાલીન મુખ્ય ન્યાયાધીશ ખેહર સાથે મળીને ન્યાયમૂર્તિ અબ્દુલ નઝીરે એ કેસમાં ઠરાવ્યું હતું કે ટ્રિપલ તલાકની જોગવાઈને રદ્દ કરવાની સત્તા સુપ્રીમ કોર્ટને નહીં, પણ સંસદને છે. એ ખંડપીઠે સરકારને આ સંબંધે કાયદો ઘડવાનો આદેશ આપ્યો હતો.
