અમદાવાદમાં બાવળા નગરપાલિકાની ડ્રેનેજ સિસ્ટમમાં સફાઈ કરવા ગયેલા ત્રણ લોકોનાં મૃત્યુ થયાં છે.
31મી માર્ચની રાતે બાવળામાં નગરપાલિકા અંતર્ગત આવતી ડ્રેનેજ સિસ્ટમમાં સફાઈ કરવા માટે કૉન્ટ્રેક્ટર રાકેશ પટેલ સફાઈ કામદારો સાથે પહોંચ્યા ત્યારે આ બનાવ બન્યો હતો.
પોલીસનું કહેવું છે કે અમિત તુલસી મકવાણા, રાજેશ પ્રભુ વાળા અને કૉન્ટ્રેક્ટર રાકેશ પટેલનું ગટરમાં ઝેરી ગૅસના કારણે ગૂંગળાઈ જવાથી મૃત્યુ થયું છે.
31 માર્ચે સાંજે 7.30 વાગ્યે અમિત ( 22 વર્ષ), અનિલ ( 26 વર્ષ), ઈશ્વર વાઘેલા, રાજેશ વાધેલા કૉન્ટ્રેક્ટર રાકેશ પટેલ સાથે બાવળામાં ગટરની સફાઈ માટે એક ગાડીમાં નીકળ્યા હતા.
ગાંધીનગર જિલ્લાના કલોલના રહેવાસી અમિતના સંબંધી પ્રવીણ પરમારનું કહેવું છે કે અમિત લગભગ બે વર્ષથી કૉન્ટ્રેક્ટર રાકેશ પટેલ સાથે કામ કરતા હતા.
અમિતના ભાઈ અનિલ મકવાણા પણ બે મહિના પહેલાં કૉન્ટ્રેક્ટ પર સફાઈ કામમાં જોડાયા હતા.
બીબીસી ગુજરાતી સાથેની વાતચીતમાં અનિલ જણાવે છે, " અમારાં મમ્મી-પપ્પા બોલી શકતાં નથી અને અમે મે મહીનાની 13 તારીખે અમિતના લગ્નની તૈયારી કરી રહ્યાં હતાં.''

ઝેરી ગૅસથી ગૂંગળાયા
સફાઈ કામદાર રાજૂભાઈ વાળાના સંબંધી બાબુભાઈ પરમારે જણાવ્યું કે 45 વર્ષના રાજૂભાઈના પરિવારમાં બે દીકરા અને એક દીકરી છે. તેઓ મૂળ સૌરાષ્ટ્રના રહેવાસી છે.
બાવળા પોલીસ સ્ટેશનના પીએસઆઈ એન.એમ.ચૌધરીએ બીબીસી ગુજરાતી સાથેની વાતચીતમાં જણાવ્યું, "31 માર્ચની રાત્રે 10 વાગ્યાની આસ-પાસ જ્યારે હોબાળો થયો ત્યારે ગ્રામ રક્ષક દળના સભ્યો અને સ્થાનિક લોકો ત્યા પહોંચી ગયા અને તેમણે મળીને ગટરમાંથી એ લોકોને બહાર કાઢ્યા. પોલીસ પણ ઘટનાસ્થળ પર પહોંચી ગઈ હતી. "
ચૌધરી ઉમેરે છે, "આ લોકો જૅટિંગ મશીન સાથે કામ કરી રહ્યા હતા પરંતુ પાણી નીકળી ગયા બાદ રાજેશ કીચડ ચેક કરવા માટે સીડી વડે ગટરમાં ઉતર્યા હતા. તે ઝેરી ગેસથી ગૂંગળાઈ ગયા અને બેભાન થઈ ગયા."
"એ પરત ના ફરતા અમિત પણ ગટરમાં ઊતર્યા. બન્નેને બચાવવા માટે કૉન્ટ્રેક્ટર રાકેશ પટેલ પણ ગટરમાં ઊતર્યા."
ચૌધરીએ કહ્યું કે જ્યારે આ લોકોને બહાર કાઢવામાં આવ્યા ત્યારે તેમની પાસે માસ્ક, યુનિફૉર્મ જેવાં કોઈ સાધનો નહોતાં.
અમદાવાદ ગ્રામ્યના પોલીસ અધિક્ષક રાજેન્દ્રકુમાર અસારીએ બીબીસી ગુજરાતીને જણાવ્યું કે અમિત, રાજેશ અને રાકેશ પટેલને હૉસ્પિટલ પહોંચાડાયા હતા પણ તેઓ બચી ના શક્યા.
અમિત અને રાજેશ બન્નેનો સંબંધ વાલ્મીકિ સમુદાય સાથે હતો.

જવાબદાર કોણ?
વાલ્મીકિ સમાજ માટે કામ કરનારી સંસ્થા 'માનવ ગરિમા' સાથે જોડાયેલા પુરુષોત્તમ વાઘેલા જણાવે છે કે વર્ષ 2013ના સુપ્રીમ કોર્ટના ચુકાદા છતાં ગુજરાતમાં ભૂગર્ભ ગટરમાં ઊતરવાને કારણે કામદારોના થઈ રહેલાં મૃત્યુની ઘટનાઓ ચાલુ જ છે.
બીબીસી ગુજરાતી સાથેની વાતચીતમાં વાઘેલાએ કહ્યું, "નગરપાલિકા આ અંગેના કામ કૉન્ટ્રેક્ટરોને આપીને પોતાની જવાબદારીમાંથી હાથ ખંખેરી લે છે."
મૃત્યુની જે ઘટના બની એ ડ્રેનેજ સિસ્ટમ બાવળા નગરપાલિકા અંતર્ગત આવતી હોવાને કારણે ત્રણેય મૃત્યુની જવાબદારી પણ બાવળા નગરપાલિકાની હોવાનું વાઘેલા માને છે.
જોકે, એફઆઈઆરમાં કૉન્ટ્રેક્ટર રાકેશ પટેલને ઘટના માટે જવાબદાર ઠેરવવામાં આવ્યા હોવાનું પોલીસ અધિક્ષક રાજેન્દ્રકુમાર અસારી જણાવે છે.
એફઆઈઆરમાં અમિતના ભાઈ અનિલે નગરપાલિકાના જવાબદાર અધિકારીઓ વિરુદ્ધ તપાસ કરવાની માગ કરી છે.
આ મામલે બીબીસી ગુજરાતી સાથે વાત કરતા ગુજરાતમાં સામાજિક ન્યાય મંત્રી ઈશ્વર પરમારે બીબીસીને કહ્યું, "સરકાર કાયદાને લાગુ કરવા માટે પૂરી રીતે ગંભીર છે. સરકાર પોતાના તરફથી કાળજી રાખે છે. આ પ્રકારની બેદરકારી કૉન્ટ્રેક્ટર તરફથી કરવામાં આવે છે. બાવળામાં જે બનાવ બન્યો છે તેમાં સફાઈ કામદારો સહિત કૉન્ટ્રેક્ટરનું પણ મૃત્યુ થયું છે. ''
તેઓ ગટરમાં સફાઈ કામદારોને ઊતારતી વખતે પૂરતા નિયમોનું પાલન કરવાની જવાબદારી નગરપાલિકાની હોવાનું જણાવે છે.
નગરપાલિકા દ્વારા કૉન્ટ્રેક્ટ ઑનલાઈન આપવામાં આવતો હોવાનું પણ પરમાર જણાવે છે.
જોકે, કૉન્ટ્રેક્ટરો પર નિયમો પળાવવાની જવાબદારી ઢોળી દેવી કેટલી યોગ્ય એ પ્રશ્નનો જવાબ તેમણે ટાળી દીધો હતો.
15 વર્ષ સુધી મોદી મુખ્યમંત્રી હતા પણ...
26 વર્ષ પહેલાં ભારતમાં માથે મેલું ઉપાડવા પર પ્રતિબંધ મૂકવામાં આવ્યો હતો પરંતુ મળ સાફ કરવા માટે ગટરમાં ઊતરનારા કેટલાય સફાઈ કામદારોનાં મૃત્યુની ઘટનાઓ સામે આવી ચુકી છે.
અમદાવાદ મિરરના એક અહેવાલ મુજબ તેમના દ્વારા સૂચનાના અધિકારના કાયદા હેઠળ કરવામાં આવેલી આરટીઆઈમાં જાણવા મળ્યુ છે કે 1993થી લઈને જાન્યુઆરી 2019 સુધી દેશમાં આ મામલે 705 મૃત્યુ થયાં હતાં અને ગુજરાતમાં 132 મૃત્યુ થયાં હતાં.
આ જાણકારી 'નેશનલ કમિશન ફૉર સફાઈ કર્મચારીઝ' તરફથી મળી હતી.
જોકે, પુરુષોત્તમ વાઘેલાનું કહેવું છે કે 2013માં મૅન્યુઅલ સ્કૅવેંજિંગ ઍક્ટ આવ્યા બાદ ગુજરાતમાં 48 લોકો આ પ્રકારના કિસ્સાઓમાં મૃત્યુ પામ્યાં છે.
તેમણે કહ્યું કે 1993માં મૅન્યુઅલ સ્કૅવેંજિંગ પર પ્રતિબંધ લગાવાયા બાદથી ગુજરાતમાં આ પ્રકારના એક પણ કેસમાં કોઈને પણ સજા થઈ નથી અને 2013 પછી કાયદા મુજબ સાધનો વસાવવામાં આવ્યાં નથી.
આ અંગે બીબીસી ગુજરાતીએ ગુજરાત સફાઈ કામદાર કૉર્પોરેશનના અધિકારીઓનો સંપર્ક સાધવા પ્રયાસ કર્યો હતો. જોકે, એ શક્ય બની શક્યો નહોતો.
બાવળામાં મૃત્યુ પામેલા અમિતના ભાઈ અનિલ જણાવે છે કે સફાઈ કામદારોને મૅન્યુઅલ સ્કૅવેંજિંગ ઍક્ટ બાબતે કોઈ જાણકારી નથી, તેમને સાધનો જેમકે માસ્ક, ગ્લવ્સ, યૂનીફૉર્મ વગેરે વસ્તુઓ અંગે પણ કહેવામાં નથી આવતું.
સફાઈ કર્મચારી આંદોલન સાથે જોડાયેલા બેજવાડા વિલ્સનનું કહેવું છે કે ગુજરાતમાં કામદારોનાં મૃત્યુ અટકાવવામાં રાજ્ય સરકાર નિષ્ફળ રહી છે.
જ્યારે જનવિકાસ સંસ્થાના જીતેન્દ્ર રાઠોડનું કહેવું છે કે નગરપાલિકાઓ અને મહાનગરપાલિકાઓ ગટર સફાઈનું કામ કૉન્ટ્રેક્ટરોને આપીને પોતાની જવાબદારીથી હાથ ખેંચી લે છે.
તેઓ જણાવે છે, "કૉન્ટ્રેક્ટરોને કામ સોંપવામાં આવે છે ત્યારે એ વાતની ચકાસણી કરવામાં નથી આવતી કે તેઓ સફાઈ કામદારોને જરૂરી સાધનો, મશીનો, માસ્ક વગેરે પૂરા પાડે છે કે કેમ? આ રીતે સરકાર મૅન્યુઅલ સ્કૅવેંજિંગ ઍક્ટનો અમલ કરવામાં બેદરકારી બતાવે છે."
"સફાઈ કર્મચારી આંદોલન સાથે જોડાયેલા બેજવાડા વિલ્સન જણાવે છે કે તમિલનાડુ બાદ ગુજરાતમાં મૅન્યુઅલ સ્કૅવેંજિંગમાં સૌથી વધુ મૃત્યુ થયાં છે."
"નરેન્દ્ર મોદી 15 વર્ષ સુધી ગુજરાતના મુખ્યમંત્રી રહ્યા પરંતુ રાજ્યમાં તેમણે આ અંગે કોઈ સિસ્ટમ વિકસાવી જ નહી."
તેઓ જણાવે છે કે કોઈ સફાઈ કામદારને માનવ મળ સાફ કરવાની ફરજ ન પડે એના માટે જે તંત્ર વિકસાવવું જોઈએ એ ન હોવાથી સફાઈ કામદારોનાં મૃત્યુ થતાં રહે છે.
ગુજરાતમાં શહેરીકરણ વધ્યું છે એટલે રાજ્યમાં આ પ્રકારના તંત્રની જરૂર છે.
પુરુષોત્તમ વાઘેલાનું કહેવું છે, "વડા પ્રધાન કુંભ મેળામાં સફાઈ કામદારોના પગ ધોવે તો ખરા પણ જે કાયદો લાગુ કરી સફાઈ કામદારોની મદદ કરવી જોઈએ એ કરતા નથી.
