'અમે કચ્છ જિલ્લાના દલિત ખેડૂતો અમારી માલિકીની જમીન પર ખેતી કરવા જઈએ તો માથાભારે શખ્સો અમારું ખૂન કરાવી શકે એમ છે. વિજય રૂપાણી સાહેબ, તમે અમને રક્ષણ આપશો કે ગુંડાઓને હાથે મરવા દેશો?'
મનની લાગણી અને ભય વ્યક્ત કરતા આ શબ્દો કચ્છના દલિત ખેડૂતોના છે. પોતાની જમીન હોવા છતાં ત્યાં પગ ન મૂકી શકવાની લાચારી તેમણે રાજ્યના મુખ્ય મંત્રી વિજય રૂપાણી, રાજ્યપાલ અને પોલીસ અધિક્ષક સમક્ષ વ્યક્ત કરી છે.
કચ્છ જિલ્લાના ભચાઉ અને રાપર તાલુકાના 116 દલિત ખેડૂતોએ સરકારને ભલામણ કરી છે કે ઊંચી જાતિના માથાભારે શખ્સો દ્વારા અતિક્રમણ કરાયેલી તેમની જમીન તેમને પરત અપાવવામાં આવે. તાજેતરમાં આ અંગે દલિત નેતા અને વડગામના ધારાસભ્ય જિજ્ઞેશ મેવાણીએ રાજ્યપાલ ઓ. પી. કોહલીને આવેદનપત્ર પાઠવ્યું હતું.
સ્થાનિક અધિકારીઓના જણાવ્યા પ્રમાણે, આ અંગે જરૂરી આદેશો આપી દેવાયા છે અને કાર્યવાહી ચાલી રહી છે.
શું છે સમગ્ર મામલો?
જિજ્ઞેશ મેવાણીએ રાજ્યપાલ ઓ. પી. કોહલીને આપેલા આવેદનપત્રમાં ઉલ્લેખ કર્યો છે કે આ દલિત પરિવારોને એએલસી હેઠળ (ઍગ્રિકલ્ચર લૅન્ડ સિલિંગ ઍક્ટ) 1984માં જમીન ફાળવવામાં આવી હતી. પરંતુ બિનદલિત દ્વારા તેમની જમીન પર ગેરકાયદે અતિક્રમણ કરવાને કારણે આ પરિવાર ખેતી કરી શકતા નથી. આ બાબત ઍટ્રોસિટી ઍક્ટની જોગવાઈઓનું ઉલ્લંઘન કરે છે જે ગેરકાયદેસર છે.
ઍટ્રોસિટી ઍક્ટની જોગવાઈ મુજબ જોઈ કોઈ એવી વ્યક્તિ જે અનુસૂચિત જાતિ કે અનુસૂચિત જનજાતિ સાથે સંબંધ ન ધરાવતી હોય અને તે અનુસૂચિત જાતિ કે અનુસૂચિત જનજાતિની વ્યક્તિની જમીન પર દબાણ કરે તો કલમ 3(1)(f) અને 3(1)(g) મુજબ ગુનો બને છે.
મેવાણીએ એવો પણ ઉલ્લેખ કર્યો છે કે વારંવાર રજૂઆતો કરવાં છતાં છેલ્લાં 35 વર્ષથી આ જમીનનો કબજો લાભાર્થીઓને મળ્યો નથી. આવેદનપત્રમાં જણાવ્યા મુજબ, જો આ ખેડૂતો પોતાની માલિકીની જમીન ખેડવા જાય તો તેમની પર જીવલેણ હુમલો થઈ શકે છે તેવી ભીતિ વ્યક્ત કરવામાં આવી છે.
કચ્છના આ ખેડૂતો માટે અવાજ ઊઠાવનારા કાર્યકર સુનિલ વિંજુડાએ બીબીસી સાથેની વાતચીતમાં કહ્યું કે 1983-84માં તત્કાલીન રાજ્ય સરકારે અનુસુચિત અને ઓબીસી (અન્ય પછાતવર્ગ) સમુદાયનું જીવનધોરણ સુધરે તે હેતુસર જમીન સંપાદન કર્યું હતું.

વિંજુડા કહ્યું, "સરકારે અનુસૂચિત જાતિ ખેતી સામુદાયિક સહકારી મંડળી બનાવી હતી. જે અંતર્ગત દલિતોને ભચાઉ તાલુકામાં 1730 એકર અને રાપર તાલુકામાં 2750 એકર જમીન ફાળવી હતી."
"આ સાથે જ ઓબીસી સમુદાયને પણ બન્ને તાલુકામાં અંદાજે ત્રણ હજાર એકર જેવી જમીન ફાળવી હતી."
"પરંતુ આ તમામ જમીન ફાળવણી માત્ર કાગળ પર કરવામાં આવી હતી. 35 વર્ષ થઈ ગયાં, પરંતુ હજુ સુધી આ ખેડૂતોને જમીનની માલિકી મળી નથી."
સહકારી આગેવાનો ઉચ્ચ જાતિના માથાભારે લોકોને કારણે જીવનું જોખમ હોવાની વાત કહે છે.
રાપર તાલુકાના મંડળી પ્રમુખ અને દલિત ખેડૂત પચનભાઈ ભદ્રુએ બીબીસી ગુજરાતી સાથેની વાતચીતમાં જણાવ્યું, "અમે છેલ્લાં ઘણાં વર્ષોથી અમારી જમીન મુદ્દે અવાજ ઊઠાવી રહ્યા છીએ, પરંતુ કોઈ મદદ નથી મળતી."
તેઓ કહે છે, "સ્થાનિક ઉચ્ચ જાતિના લોકો અમને મારી નાખવાની ધમકી પણ આપી રહ્યા છે. બીજું કે મહેસૂલ વિભાગમાં પણ ઘણી રજૂઆતો કરવા છતાં કોઈ મદદ કરવા તૈયાર નથી."
જિજ્ઞેશ મેવાણીએ પાઠવેલું આવેદનપત્ર
એક ઘટનાને યાદ કરતા સુનિલ વિંજુડાનું કહે છે, "થોડા સમય અગાઉ આ મુદ્દે સરકારી અધિકારીઓની હાજરીમાં બેઠક યોજાઈ હતી."
"તે સમયે દલિતોને જમીન આપવાની વાત કરવામાં આવી, ત્યારે બધાને સામે સ્થાનિક માથાભારે શખ્સોએ અમને મારી નાખવાની ધમકી પણ ઉચ્ચારી હતી."
ભચાઉ તાલુકા મંડળીના પ્રમુખ વિરજીભાઈએ બીબીસી ગુજરાતી સાથેની વાતચીતમાં જણાવ્યું, "અમારી જમીનનો, જે સરકારી કર આવે છે તે અમે ભરીએ છીએ, પરંતુ ખેતી કોઈ અન્ય જ કરે છે. આવું માત્ર હિંદુસ્તાનમાં જ બની શકે."
આ મુદ્દે કચ્છ જિલ્લાના ઍડિશનલ કલેક્ટર બી. એસ. ઝાલાએ બીબીસી ગુજરાતી સાથેની વાતચીતમાં કહ્યું કે ગત વર્ષે સરકારે પરિપત્ર દ્વારા જાણ કરી હતી કે જે પણ લાભાર્થીઓ છે તેમના સર્વે નંબર કઢાવી તાત્કાલિક ધોરણે જમીનનો કબજો સોંપી દેવો.
તેમણે વધુમાં કહ્યું, "રાપર તાલુકાના ગામોમાં જમીન સોંપણીની કાર્યવાહી હાથ ધરી દેવામાં આવી છે. આ સિવાય મંડળીના સભ્યો સાથે બેઠકો હાથ ધરી મુદ્દાનું નિરાકરણ કાઢવામાં આવી રહ્યું છે."
ઝાલાએ જણાવ્યું કે ગત વર્ષે ઍટ્રોસિટીના સાત કેસ નોંધવામાં આવ્યા હતા, પરંતુ હાલમાં આવા કોઈ કેસ નથી આવ્યા નથી.
તેઓ કહે છે, "જો કોઈ ઍટ્રોસિટીનો કેસ સામે આવશે તો કાયદાકીય રીતે તેનો નિકાલ કરવામાં આવશે."
