એક તરફ ગુજરાત રાજ્યમાં સરદાર સરોવર ડૅમના મહત્તમ સપાટી સુધી પહોંચી જવાની ઉજવણી ચાલી રહી છે ત્યારે બીજી તરફ મધ્યપ્રદેશમાં 178 ગામો પાણીમાં ડૂબેલાં છે.
નર્મદા ડૅમની જળસપાટી 13 સપ્ટેમ્બર રાતે 137 મીટરને પાર પહોંચી ગઈ હતી. નર્મદા નદી પરના સરદાર સરોવર ડૅમની જળસપાટી મામલે ગુજરાત અને મધ્યપ્રદેશની સરકારો તથા સત્તારૂઢ રાજકીય પક્ષો આમને-સામને છે.
'વિક્રમી સપાટી પાર કરવા'ની ઉજવણી ગુજરાતના સત્તા પક્ષ દ્વારા જોરશોરથી કરાઈ રહી છે.
આ ઉજવણી અંતર્ગત 17 સપ્ટેમ્બરે વડા પ્રધાન નરેન્દ્ર મોદીના જન્મદિને 'નમામિ દેવી નર્મદે મહોત્સવ'ની ઉજવણી કરવાની જાહેરાત પણ કરી દેવાઈ છે.

ગુજરાત રાજ્યના મુખ્ય મંત્રી વિજય રૂપાણીએ કહ્યું, "નર્મદા ડૅમમાંથી પાણી ભરવું એ અમારો અધિકાર છે."
આ મામલે તેમણે કૉંગ્રેસ પર નિશાન સાધતાં કહ્યું, "કૉંગ્રેસશાસિત રાજ્ય મધ્યપ્રદેશ નહોતું ઇચ્છતું કે આ ડૅમ બને."
સામે પક્ષે મધ્યપ્રદેશની કૉંગ્રેસ સરકાર પણ ગુજરાતની ભાજપ સરકાર પર વળતા આક્ષેપો કરી રહી છે.
આ અગાઉ જુલાઈ 2019માં પણ ગુજરાતના મુખ્ય મંત્રી વિજય રૂપાણી અને મધ્યપ્રદેશની સરકારના નેતા વચ્ચે પણ વાકયુદ્ધ છેડાયું હતું.
રાજ્યોની સરકારોથી અલગ એક એક એવી ઑથોરિટી છે જેના હાથમાં સરદાર સરોવરની કમાન છે.
શું છે નર્મદા કંટ્રોલ ઑથોરિટી?
ગુજરાત, મધ્યપ્રદેશ, રાજસ્થાન અને મહારાષ્ટ્ર, આ ચાર રાજ્યો વચ્ચે નર્મદાના પાણીની વહેંચણી મામલે અગાઉ વિવાદ સર્જાયા હતા.
નર્મદા કંટ્રોલ ઑથોરિટી આ ચાર રાજ્યો વચ્ચે નર્મદાનાં પાણી, વીજઉત્પાદન સહિતની બાબતો અંગે મધ્યસ્થી કરતી બૉડી છે.
નર્મદા વૉટર ડિસ્પ્યૂટ ટ્રિબ્યૂનલ(NCA)ના આખરી નિર્ણયો અને હુકમોના અમલીકરણ માટે નર્મદા કંટ્રોલ ઑથોરિટીની રચના કરવામાં આવી હતી.
20 ડિસેમ્બર 1980થી નર્મદા કંટ્રોલ ઑથોરિટી કાર્યરત છે. NCAનું વડું મથક મધ્યપ્રદેશના ઇંદૌરમાં આવેલું છે.
ગુજરાત રાજ્યની ભાજપ સરકારના પૂર્વ મંત્રી ડૉ.જયનારાયણ વ્યાસે બીબીસી ગુજરાતી સાથેની વાતચીતમાં જણાવ્યું, "નર્મદા કંટ્રોલ ઑથોરિટી એ ઍક્ઝિક્યુટિવ ઑથોરિટી છે."
"કયા રાજ્યે કેટલું પાણી છોડવું, ગુજરાતે-મધ્યપ્રદેશે કેટલું પાણી છોડવું તથા કેટલી વીજપેદાશ થઈ, આ પ્રકારના મામલાઓનું સંચાલન NCA કરે છે."
NCA શું કરે છે? નર્મદા પરના તમામ પ્રોજેક્ટનાં સંકલન અને નિયમનની જવાબદારી નર્મદા કંટ્રોલ ઑથોરિટીની છે.
પર્યાવરણ સુરક્ષા માટે આવશ્યક પગલાં લેવાનું તથા નર્મદા પર થતાં કાર્યોને લીધે સર્જાતા પુનર્વસનના પ્રશ્નનું નિરાકરણ લાવવાની જવાબદારી પણ NCAની છે.
નર્મદા વૉટર ડિસ્પ્યૂટ્સ ટ્રિબ્યૂનલના હુકમનું પાલન કરાવવું.
નર્મદાનાં પાણીનાં સંગ્રહ, વહેંચણી, નિયમન અને નિયંત્રણનું કામ કરવું.
ઉત્પન થતી વીજળીની નિયત કરાયેલા પ્રમાણમાં વહેંચણી થાય એ માટે દેખરેખ રાખવી.
મધ્યપ્રદેશ દ્વારા છોડાતાં પાણીનું નિયમન કરવું.
પુનર્વસન, પુન:સ્થાપન અને વળતર આપવાની કામગીરી કરવી.
કોણ છે નર્મદા કંટ્રોલ ઑથોરિટીના સભ્યો?
NCAની બૉડીમાં કુલ 16 સભ્યો હોય છે, ભારત સરકારના જળસંસાધન મંત્રાલયના સેક્રેટરી આ બૉડીના ચૅરમૅન હોય છે.
ગુજરાત, મધ્ય પ્રદેશ, રાજસ્થાન અને મહારાષ્ટ્ર રાજ્યના પ્રતિનિધિ તરીકે ચારેય રાજ્યોના ચીફ સેક્રેટરી NCAના સભ્ય હોય છે.

ભારત સરકારના સેક્રેટરી, ઊર્જામંત્રાલય - સભ્ય

આ સમિતિમાં આ ઉપરાંત કેન્દ્ર સરકાર દ્વારા ત્રણ સભ્યો પસંદ કરાય છે જે ચીફ એન્જિનિયરથી નીચેના દરજ્જાના ન હોવા જોઈએ.
આ ઉપરાંત એક સ્વતંત્ર સભ્યની પસંદગી કેન્દ્ર સરકાર દ્વારા કરાય છે, જેઓ પર્યાવરણ અને પુનર્વસવાટ મામલાના જાણકાર હોવા જોઈએ.
તેઓ ભારત સરકારના જૉઇન્ટ સેક્રેટરી અથવા રાજ્ય સરકારના એડિશનલ સેક્રેટરીથી નીચેના દરજ્જાના ન હોવા જોઈએ.
આ સાથે એન્જિનિયર-ઇન-ચીફ દરજ્જાના ચાર સભ્યોની પસંદગી ગુજરાત, મધ્યપ્રદેશ, મહારાષ્ટ્ર અને રાજસ્થાન એમ ચારેય રાજ્ય દ્વારા કરાય છે.
'NCA અંતિમ મધ્યસ્થી નથી'
નર્મદા કંટ્રોલ ઑથોરિટીમાં ગુજરાત, મહારાષ્ટ્ર, મધ્યપ્રદેશ અને રાજસ્થાન એમ ચાર રાજ્યોના પ્રતિનિધિ સંકળાયેલા છે.
ઑથોરિટી(NCA)ને ઉપરોક્ત ચાર રાજ્યો દ્વારા સરખા હિસ્સે ભંડોળ આપવામાં આવે છે.
જોકે, નર્મદા મામલે ચાર રાજ્યો વચ્ચે મધ્યસ્થી કરાવનાર અંતિમ ઑથોરિટી NCA નથી.
વ્યાસ જણાવે છે, "નર્મદા કંટ્રોલ ઑથોરિટી એ અધિકારીઓની સમિતિ છે. તેની ઉપર રિવ્યૂ કમિટી ઑફ નર્મદા કંટ્રોલ ઑથોરિટી (RCNCA) છે."
વ્યાસ આ વિશે જણાવતાં કહે છે, "કેન્દ્રીય જળસંસાધન મંત્રી RCNCA ચૅરમૅન હોય છે અને ચારેય રાજ્યોના મુખ્ય મંત્રી તેના સભ્યો છે."
"RCNCAમાં પણ સમાધાન ન આવે તો વડા પ્રધાન અંતિમ મધ્યસ્થી છે, વડા પ્રધાનને કોઈ પણ વિવાદ માટે ફાઇનલ આબ્રિટ્રૅટરની સત્તા આપવામાં આવી છે."
NCAની જરૂર કેમ પડી?
નર્મદા ખીણ યોજના (Narmada Valley Project - NVP) અંતર્ગત 30 મોટા, 136 મધ્યમ અને ત્રણ હજાર નાના ડૅમ બનાવવાનું આયોજન મૂળરૂપે કરવામાં આવ્યું હતું.
ગુજરાતનો સરદાર સરોવર પ્રોજેક્ટ અને મધ્યપ્રદેશનો નર્મદા સાગર પ્રોજેક્ટ એ 'નર્મદા ખીણ યોજના'ના સૌથી મહત્ત્વાકાંક્ષી પ્રોજેક્ટ મનાતા હતા.
સરદાર સરોવર ડૅમને સૌથી મોટો પ્રોજેક્ટ રાખવાનું કારણ એવું હતું કે તે નર્મદા નદી પરનો અંતિમ ડૅમ છે અને એનાથી આગળ ભરૂચમાં નર્મદા નદીનો સાગર સાથે સંગમ થાય છે.
ડૉ. જયનારાયણ વ્યાસ જણાવે છે કે મૂળે ખોસલા કમિટીએ આ ડૅમ બાંધવાનું સૂચન કર્યું હતું અને તેની ઊંચાઈ પહેલાં 510 ફૂટ નક્કી કરાઈ હતી.
ડૉ. વ્યાસ કહે છે, "જોકે 510 ફૂટની ઊંચાઈનો મહારાષ્ટ્ર અને મધ્યપ્રદેશ રાજ્યોએ વિરોધ કર્યો હતો."
વિરોધ કરવા પાછળ આ બન્ને રાજ્યોની દલીલ હતી કે 510 ફૂટની ઊંચાઈને કારણે મોટો વિસ્તાર ડૂબમાં જશે અને લોકોના વિસ્થાપનનો મોટો પ્રશ્ન સર્જાશે.
ડૉ. વ્યાસ કહે છે, "આ મુદ્દો ટ્રિબ્યૂનલમાં ગયો અને ચૂકાદામાં ઊંચાઈ 510 ફૂટથી ઘટાળીને 455 ફૂટ નક્કી કરવામાં આવી."
"જો 455 ફૂટ ઊંચાઈ પ્રમાણે પૂરેપૂરો બંધ ભરાઈ જાય તો પણ ગુજરાતને કરાર પ્રમાણે 9 મિલિયન એકર ફૂટ પાણી ન મળે."
ગુજરાતને 9 મિલિયન એકર ફૂટ, મધ્યપ્રદેશને 18.25 મિલિયન એકર ફૂટ, મહારાષ્ટ્રને 0.25 મિલિયન એકર ફૂટ અને રાજસ્થાનને 0.5 મિલિયન એકર ફૂટ એમ નર્મદાનાં કુલ 28 મિલિયન એકર ફૂટ પાણીની વહેંચણી કરવામાં આવી છે.
નર્મદાનાં પાણીની વહેંચણીનું પ્રમાણે નર્મદા વૉટર ડિસ્પ્યૂટ્સ ટ્રિબ્યૂનલ દ્વારા 1979માં નક્કી કરવામાં આવ્યું હતું.
આ પ્રમાણે વહેંચણી થાય અને નર્મદા વૉટર ડિસ્પ્યૂટ્સ ટ્રિબ્યૂનલના અન્ય હુકમોનું પાલન થાય એ માટે જ નર્મદા કંટ્રોલ ઑથોરિટીની રચના કરવાની જરૂર પડી
શું છે નર્મદા વૉટર ડિસ્પ્યૂટ્સ ટ્રિબ્યૂનલના નિર્ણયો?
સામાન્ય વર્ષમાં મધ્યપ્રદેશે ગુજરાત અને રાજસ્થાનની પાણીની જરૂરિયાતને પહોંચી વળવા 8.12 મિલિયન એકર ફૂટ પાણી છોડવું.
ટ્રિબ્યૂનલના નિયમોની અમલવારી માટે નર્મદા કંટ્રોલ ઑથોરિટીનું ગઠન કરવું અને તેના રિવ્યૂ માટે એક રિવ્યૂ કમિટી રચવી.
ટ્રિબ્યૂલના નિર્ણયની 45 વર્ષ બાદ સમીક્ષા કરી શકાશે.ઑગસ્ટ મહિનામાં સરદાર સરોવર ડૅમનું જળસ્તર 134 મીટર સુધી પહોંચી ગયું ત્યારે પણ મધ્યપ્રદેશના ગામોમાં પાણીમાં ડૂબી ગયાં હતાં.
34 વર્ષથી 'નર્મદા બચાવો' આંદોલન અંતર્ગત વિસ્થાપિતોના અધિકારો માટે લડતાં મેધા પાટકર ઑગસ્ટ મહિનાના અંતમાં મધ્યપ્રદેશના બડવાણી જિલ્લાના બડ્ડા ગામમાં અનિશ્ચિત કાળ માટે ઉપવાસ પર બેઠાં હતાં અને અંતે તેમણે પારણાં કર્યાં હતાં.
સરદાર સરોવર ડૅમના વધી રહેલા જળસ્તર મામલે સુપ્રીમ કોર્ટમાં પિટિશન દાખલ કરાઈ છે, જેમાં મધ્ય પ્રદેશનાં 178 ગામો પર ખતરો હોવાનો ઉલ્લેખ કરાયો છે.
આ પિટિશન પ્રમાણે, 'મધ્ય પ્રદેશ સરકાર દ્વારા પુનર્વસનની કામગીરી પૂરી કરાઈ નથી, પરંતુ નર્મદા કંટ્રોલ ઑથોરિટી સતત ડૅમની જળસપાટી વધારી રહી છે. જેને લીધે 178 ગામો પર ડૂબમાં જવાનો ખતરો છે.'
