क्या भारत में लीगल हैं क्रिप्टोकरेंसी? क्यों कनफ्यूज हैं निवेशक...

दुनियाभर में निवेशकों में क्रिप्टोकरेंसी आकर्षण का केंद्र बनी हुई है। इस डिसेंट्रलाइज्ड डिजिटल करेंसी को दुनिया के अधिकांश देशों में मान्यता नहीं मिली है, इसके बाद भी लोगों में इसका क्रेज तेजी से बढ़ रहा है। बिटकॉइन से लेकर टिथर तक कई क्रिप्टो कॉइन लोगों की जुबान पर चढ़ गए हैं।

क्रिप्टोकरेंसी नियमन के दायरे में नहीं है। इसकी कीमत में भारी उतार-चढ़ाव रहता है। कई देशों ने क्रिप्टोकरेंसी को लीगल कर दिया है। भारत में सरकार ने इसे अभी मान्यता भी नहीं दी है, लेकिन इसमें निवेश करने वाले भारतीयों से टैक्स जरूर वसूल करना चाहती है। इस तरह की आवाजें उठ रही हैं कि इन्हें विदेशी संपत्ति जैसा माना जाए।

भारत में क्रिप्टोकरेंसी गैरकानूनी भी नहीं है। यानी आप बिटकॉइन खरीद और बेच सकते हैं। यहां तक बतौर इन्वेस्टमेंट इसे रख भी सकते हैं। लेकिन, इसकी देखभाल या सुरक्षा के लिए कोई गवर्निंग बॉडी नहीं है। इसी वजह से लोग इसमें निवेश से कतराते हैं।

क्या है सुभाष गर्ग कमेटी की सिफारिश : केंद्र सरकार ने क्रिप्टोकरेंसी को लेकर पूर्व वित्त सचिव सुभाष गर्ग की अध्यक्षता में एक्सपर्ट कमेटी का गठन किया था। कमेटी ने 2019 में अपनी सिफारिशों में क्रिप्टोकरेंसी पर पूर्ण प्रतिबंध लगाने की प्रस्ताव रखा था। समिति ने अपनी सिफारिश में कहा था कि निजी क्रिप्टोकरेंसी में कोई अंतर्निहित मूल्य नहीं है। इनका कोई निर्धारित मूल्य नहीं है। निजी क्रिप्टोकरेंसी न तो मूल्य के भंडार के रूप में कार्य करती है और न ही यह विनिमय का माध्यम है।

RBI की चिंता : रिजर्व बैंक के गवर्नर शक्तिकांत दास केंद्रीय बैंक बिटकॉइन जैसी क्रिप्टोकरेंसी को लेकर ‘गंभीर’ रूप से चिंतित है और उन्होंने सरकार को इस चिंता से अवगत करा दिया है। उन्होंने कहा कि क्रिप्टो करेंसी के अर्थव्यवस्था में योगदान के विषय में ‘विश्वसनीय स्पष्टीकरण और जवाब’ की जरूरत है।

क्या कहता है सुप्रीम कोर्ट : रिजर्व बैंक ने शुरुआत में बैंकों को इस तरह की संपत्ति में निवेशकों द्वारा कारोबार की अनुमति को प्रतिबंधित कर दिया था। लेकिन, सुप्रीम कोर्ट ने रिजर्व बैंक के आदेश को रद्द कर दिया जिसके बाद इसकी अनुमति मिल गई।

भारत में बन सकता है नया कानून : भारत में सरकार इसे रेगुलेट करने पर विचार कर रही है। भारत क्रिप्टोकरेंसी को लेकर एक नया कानून पेश करने की योजना भी बनाई जा रही है। सरकार ने इस संबंध में 'क्रिप्‍टोकरेंसी एंड रेगुलेशन ऑफ ऑफिशियल डिजिटल करेंसी बिल, 2021’ के नाम से एक बिल पेश करने का प्रस्‍ताव दिया था। यह भी कहा जा रहा है कि सरकार ने क्रिप्टोकरेंसी पर प्रतिबंध लगाने का विचार पूरी तरह त्याग दिया है।
