महाराष्ट्र के धुले ज़िले के राइनपाडा गांव में रविवार को आक्रोशित भीड़ ने एक समुदाय के पांच लोगों को 'बच्चा चोर' होने के शक में पीट-पीटकर मार डाला। ये सभी लोग घूम-घूमकर भीख मांगने के लिए सोलापुर ज़िले से आए थे और कुछ दिन पहले ही इन लोगों ने धुले ज़िले के बाहर अपना डेरा जमाया था।
ये सभी उस समय इस क्षेत्र से गुज़रे जब बच्चा चोर समूह के महाराष्ट्र पहुंचने की अफ़वाह फैल रही थी। स्थानीय पुलिस प्रशासन ने सामूहिक हत्या के इस मामले में बच्चा चोर समूह से जुड़ी अफ़वाहों को एक वजह बताया है। महाराष्ट्र पुलिस के डीजीपी दत्ता पडसालगिकर ने अपील की है कि व्हाट्सऐप पर फैलने वाली अफ़वाहों पर यक़ीन न किया जाए।
सामूहिक हत्याओं का व्हाट्सऐप कनेक्शन
बीते कुछ महीनों में ऐसे कई मामले सामने आए हैं, जिनमें व्हाट्सऐप और सोशल मीडिया से फैलने वाली अफ़वाहें सामूहिक हत्याओं की एक वजह बनी है। इनमें धुले ज़िले में पांच लोगों और असम में दो युवाओं की हत्या समेत अब तक 8 हत्याएं शामिल हैं।
दरअसल, व्हाट्सऐप पर एक वीडियो वायरल हो रहा है जिसमें दो बाइक सवारों को बच्चा चुराते देखा जा रहा है। बीते दो जुलाई को उत्तर प्रदेश के शामली में पुलिस ने एक व्हाट्सऐप ग्रुप के दो प्रशासकों को गिरफ़्तार किया है। इसके साथ ही विवादित संदेश को अपलोड करने वाले और ग्रुप के तीसरे एडमिन की तलाश जारी है।
इंडियन एक्सप्रेस की ख़बर के मुताबिक़, इन चारों लोगों के ख़िलाफ़ आईपीसी की धारा 505 (1) और 295 के तहत मामला दर्ज किया गया है। इसी तर्ज पर जम्मू-कश्मीर पुलिस ने सोशल मीडिया पर अमरनाथ यात्रियों पर हमले की झूठी ख़बर फैलाने के मामले में अज्ञात लोगों के ख़िलाफ़ मामला दर्ज किया है।
व्हाट्सऐप पर अफ़वाह
इंस्टेंट मैसेज़िंग मोबाइल ऐप व्हाट्सऐप का इस्तेमाल हर उम्र वर्ग के लोग करते हैं। ये अलग-अलग विचारधाराओं और समुदायों के होते हैं। ऐसे में सवाल ये उठता है कि व्हाट्सऐप पर बात करने वाले और संदेशों का आदान-प्रदान करने वालों को किसी अफ़वाह को आगे बढ़ाने पर किस तरह की क़ानूनी कार्रवाई का सामना करना पड़ सकता है।
साइबर कानून के जानकार और वकील अपार गुप्ता ने बीबीसी हिंदी को बताया है कि व्हाट्सऐप का इस्तेमाल करने वालों को ज़िम्मेदारी से इसका प्रयोग करना चाहिए।

1 - अफ़वाह फैलाने की सज़ा
अपार गुप्ता बताते हैं, "व्हाट्सऐप पर अफ़वाह फैलाने के मामले में ऐसा नहीं है कि जिसने पहली बार मैसेज़ भेजा हो, उस व्यक्ति के ख़िलाफ़ ही क़ानूनी कार्रवाई की जाए, बल्कि वो व्यक्ति जो ऐसी अफ़वाहों को आगे बढ़ाता है उसका नाम भी अपराध से जुड़ सकता है।"
लेकिन ऐसे मामलों में इस तरह के संदेशों को आगे बढ़ाने के तरीक़ों को भी ध्यान में रखा जा सकता है। गुप्ता कहते हैं, "कभी-कभी ऐसा भी होता है कि आप ऐसे संदेशों का मज़ाक उड़ाते हुए, उन पर टिप्पणी करते हुए और उनका विरोध करते हैं। ऐसे मामलों में पुलिस को संदर्भ का भी ध्यान रखा जाना चाहिए। ऐेसे में जिसने मैसेज़ बनाया और जिसने आगे फैलाया, वो दोनों ही अपराधी हो सकते हैं।"
"भारतीय दंड संहिता की धारा 505 के तहत अगर कोई जानबूझकर ऐसी अफ़वाहों को आगे बढ़ाता है जिससे शांति भंग हो सकती है तो उस व्यक्ति के ख़िलाफ़ क़ानूनी कार्रवाई हो सकती है।"
2- अफ़वाह पाने वाले के ख़िलाफ़ कार्रवाई
व्हाट्सऐप यूज़र्स जांच के दायरे में तब भी आ सकते हैं अगर उनके पास आपत्तिज़नक कंटेंट आते हैं। अपार गुप्ता कहते हैं कि अगर कोई व्यक्ति आपत्तिज़नक संदेश हासिल करता है तो पुलिस फ़ोन ज़ब्त कर सकती है और जांच में सहयोग करने के लिए कह सकती है।
3- अफ़वाह मिले तो क्या करें
व्हाट्सऐप पर दिन भर तमाम तरह की असली-नक़ली ख़बरें पाने वाले आमतौर पर उन्हें नज़रअंदाज़ करते हैं, लेकिन ये करना भी उचित नहीं है। अपार गुप्ता कहते हैं कि कोई भी विवादास्पद मैसेज़ हासिल करने वालों को ऐसा संदेश मिलते ही मैसेज़ भेजने वाले को रिप्लाई करके उस मैसेज़ के संदर्भ में बात करनी चाहिए। वह कहते हैं कि ऐसे मैसेज़ पाने वाले लोग अपने फ़ोन पर इस तरह के संदेशों को स्पैम मार्क या रिपोर्ट कर सकते हैं।
