जब चलती बस-मेट्रो में लड़के होते हैं यौन उत्पीड़न का शिकार

"मैं फॉर्म भरने की लाइन में खड़ा था, तभी उन्होंने पीछे से मुझ पर अपना प्राइवेट पार्ट टच किया।" बिक्रम का इतना कहना था कि उनके आस-पास बैठे उनके तीन दोस्त ठहाके मारकर हंसने लगे। वो एक सुर में कहने लगे कि अच्छा आगे बताओ फिर क्या हुआ।

बिक्रम थोड़ा हिचकिचाए और फिर बताने लगे, ''जब तक मैं लाइन में लगा रहा, उन्होंने कई बार ऐसा किया। मेरे पीछे खड़े अंकल की उम्र 50 साल से ऊपर रही होगी और मैं उस समय कॉलेज जाने वाला लड़का था। जब मैंने अंकल से कहा कि वे ठीक से खड़े हो जाएं तो उन्होंने मुस्कुराते हुए कहा- 'क्या हो गया, रहने दो ना।''

दिल्ली में नौकरी करने वाले बिक्रम के साथ हुई इस घटना को लगभग आठ साल बीत चुके हैं, लेकिन आज भी उन्हें सब याद है। वो बताते हैं, ''मैं उन अंकल की उम्र का सम्मान करते हुए बहुत देर तक यह सब सहता रहा लेकिन आख़िरकार गुस्से में मैंने उन्हें बहुत बुरा-भला कहा।''

बीबीसी से इस बात को साझा करते हुए उन्होंने साफ़ किया कि इतने सालों में वो पहली बार किसी के सामने इस घटना का ज़िक्र कर रहे हैं। इसके पहले उन्हें कभी कोई ऐसा दोस्त नहीं मिला जो पूरी संवेदनशीलता के साथ उनकी परेशानी समझ पाता। हालांकि, जिस वक्त बिक्रम 'संवेदनशीलता' की बात कर रहे थे, उस वक़्त भी उनके दोस्त दबी हुई हंसी में अपनी असंवेदनशीलता दर्शा रहे थे।

बस में सीट देने के बहाने उत्पीड़न

इस तरह की घटना उत्तर प्रदेश के रहने वाले कपिल शर्मा के साथ भी हुई। कपिल के साथ पहली बार ऐसा तब हुआ जब वो 10 साल के थे। उनके मुताबिक़, वो आज भी बसों में सफ़र करते समय इससे जूझते हैं जबकि आज वो नौकरी पेशा हैं और सरकारी नौकरी में हैं।

कपिल अपना अनुभव साझा करते हुए कहते हैं, ''मैं नौकरी के सिलसिले में लखनऊ से दिल्ली आया था और अक्सर बस से सफ़र करता था। इसी तरह एक दिन एक अधेड़ उम्र के आदमी ने मुझे अपने पास बैठने के लिए सीट दी। मैं भी ख़ुशी-ख़ुशी बैठ गया, लेकिन थोड़ी देर बाद वह आदमी मेरे प्राइवेट पार्ट की तरफ अपना हाथ लगाने लगा। मुझे लगा बस में भीड़ है, इस वजह से शायद उनका हाथ लग गया हो, लेकिन वे लगातार ऐसी हरकत करते रहे। मैं किसी को कुछ बता भी न पाया। चुपचाप सहता रहा।''

लेकिन ये पूछे जाने पर कि आख़िर लड़के इस तरह की घटना में चुप क्यों रहते हैं, कपिल बेझिझक बताते हैं, "इसके पीछे एक तरह का डर होता है। डर इस बात का कि दोस्तों के बीच मेरी छवि एक कमज़ोर पुरुष वाली न बन जाए। ऐसा इसलिए भी क्योंकि हमारा समाज लड़कों को शुरुआत से ही ताकतवर, मज़बूत, कभी ना रोने वाला जैसे विशेषणों में ढाल देता है।"

क्या है फ़्रोटेरिज़्म

बिक्रम और कपिल के साथ सार्वजनिक स्थानों पर हुई इस तरह की छेड़छाड़ की तस्दीक़ दूसरे पुरुष भी करते हैं। आख़िर ऐसी क्या वजह है कि यौन उत्पीड़न के शिकार पुरुष अपने साथ हुई घटनाओं को अक्सर छिपाते हैं।

दिल्ली में मनोचिकित्सक डॉक्टर प्रवीण त्रिपाठी भी कपिल की बात से सहमति जताते हैं। बीबीसी से बातचीत में डॉ. प्रवीण कहते हैं, "इसके पीछे सबसे बड़ी वजह शर्मिंदगी का डर होता है। पुरुषों को लगता है कि उनके दोस्त या परिजन उन पर हंसेंगे। पुरुषों के भीतर घर कर गई तथाकथित मर्दानगी की भावना भी उन्हें अपने साथ हुई छेड़छाड़ की घटना को साझा करने से रोकती है।"

पुरुषों के साथ सार्वजनिक स्थानों पर होने वाले यौन उत्पीड़न के मामलों में एक और बात जो निकलकर आती है, वह यह कि इस तरह की हरकतें करने वालों में ख़ुद पुरुष ही शामिल रहते हैं।

इन पुरुषों की मानसिकता के बारे में डॉ. प्रवीण कहते हैं कि ये लोग 'फ़्रोटेरिज़्म' नामक बीमारी के शिकार होते हैं। इस बीमारी से ग्रसित व्यक्ति किसी दूसरे व्यक्ति के जेनेटिकल पार्ट को छूने से एक तरह की यौन संतुष्टि प्राप्त करता है। इसके लिए वह दूसरे व्यक्ति की सहमति भी नहीं मांगता।

इस बीमारी में और क्या क्या होता है?

डॉ. प्रवीण कहते हैं, ''यौन उत्पीड़न के अधिकतर मामले अपनी ताक़त दर्शाने की कोशिश होती है। पुरुषों के ज़रिए पुरुषों के यौन उत्पीड़न के मामलों में ताक़त का प्रदर्शन और ज़्यादा हो जाता है।''

ऐसी कई रिपोर्ट भी हैं जिनसे यह पता चला है कि पुरुषों के ज़रिए पुरुषों का रेप करने की घटनाओं में यौन सुख प्राप्त करने की बजाय अपनी ताक़त दर्शाना बड़ी वजह रही है। महिलाओं के साथ होने वाले यौन उत्पीड़न का जितना असर उन पर पड़ता है, ठीक वैसा ही असर पुरुषों पर भी होता है।

डॉक्टरों का मानना है कि कई बार इस ट्रॉमा से बाहर निकलने में उन्हें सालों लग सकते हैं। कपिल कहते हैं, ''मैं आज भी इस तरह की घटनाओं को याद कर सिहर जाता हूं और चाहता हूं कि मेरी आने वाली पीढ़ी को यूं घुट-घुटकर ना रहना पड़े। वह खुलकर अपने साथ होने वाले यौन उत्पीड़न की शिकायत करें।''

पुलिस में दर्ज क्यों नहीं करते मामला?

कपिल शर्मा ने जब अपने साथ कई सालों तक अलग-अलग जगहों पर हुई छेड़छाड़ की बातें बताईं, तो उनसे एक सवाल पूछना वाजिब था कि आख़िर उन्होंने इसकी रिपोर्ट कभी पुलिस को क्यों नहीं की।

तपाक से कपिल के मुंह से जवाब निकला, "पुरुषों के साथ छेड़छाड़ के मामले पर सबसे पहले तो कोई यकीन ही नहीं करता और एक बार के लिए कोई विश्वास कर भी ले तो भारतीय क़ानून भी इस तरह के मामलों में पुरुषों का साथ नहीं देता।"

ऐसे में सवाल उठता है कि ऐसे पीड़ित पुरुषों के लिए आख़िर क़ानून में क्या है?

दिल्ली हाईकोर्ट के वकील विभाष झा कहते हैं, "भारतीय दंड संहिता आईपीसी में धारा 354 के तहत यौन उत्पीड़न के मामले दर्ज किए जाते हैं। इसके अलावा धारा 376 और 509 के तहत भी यौन हिंसा से जुड़े मामलों को दर्ज किया जाता है। क़ानून में लिखा है कि इसमें पीड़िता महिला है। साथ ही धारा 509 में महिला की मर्यादा का हनन होने की बात कही गई है। इस तरह से ये क़ानून पुरुषों के ख़िलाफ़ ही हो जाते हैं और पुरुष इन धाराओं के तहत मामला दर्ज नहीं करवा सकते।''

विभाष बताते हैं कि 18 साल से कम उम्र के लड़का या लड़की के यौन उत्पीड़न के मामले में तो पोक्सो क़ानून कारगर हो जाता है लेकिन वयस्क पुरुषों के मामले में क़ानून उनके साथ नहीं रहता। हालांकि, वकील अनुजा कपूर की राय इस संबंध में थोड़ी जुदा है। वो कहती हैं कि पुरुषों के साथ होने वाले यौन उत्पीड़न या छेड़छाड़ जैसे मामलों को भी इन्हीं धाराओं के तहत दर्ज किया जाना चाहिए।

उनके मुताबिक़, ''अगर पुरुषों के साथ छेड़खानी या यौन उत्पीड़न होता है तो उन्हें पुलिस में मामला दर्ज करवाने जाना चाहिए और अगर पुलिस मामला ना दर्ज करे तो इसके ख़िलाफ़ जनहित याचिका दायर करनी चाहिए।''

अनुजा इस बात पर सहमत दिखती हैं कि पुरुष भी यौन उत्पीड़न का शिकार होते हैं। उनकी राय है कि जब तक पुरुष एकजुट होकर अपने हक़ की मांग नहीं करेंगे तब तक क़ानून में भी बदलाव नहीं हो पाएगा। इसका सीधा-सा उदाहरण है महिलाएं। अपने ख़िलाफ़ हो रही घटनाओं पर एकजुट होकर उन्होंने आवाज़ उठाई और कई क़ानून में बदलाव करवाए।
