30 जून को असम में नागरिकता के नेशनल रजिस्टर को अपडेट करने की लंबी प्रक्रिया पूरी हो चुकी है। सुप्रीम कोर्ट की निगरानी में चल रही ये प्रक्रिया असम के भारतीय नागरिकों के नाम ड्राफ़्ट रजिस्टर में प्रकाशित होने के साथ ही ख़त्म हो जाएगी। इसकी वजह से असम में रह रहे बंगाली बोलने वाले क़रीब 90 लाख मुसलमानों के बीच ज़बरदस्त घबराहट का माहौल है। मुसलमानों के बरक्स काफ़ी कम तादाद वाले बंगाली हिंदू भी परेशान हैं।
नागरिकता के राष्ट्रीय रजिस्टर की प्रक्रिया का संयोजन कर रहे अधिकारी डॉक्टर प्रदीप हजेला के हवाले से ख़बर आई थी कि असम में रह रहे क़रीब 48 लाख लोग अपने भारतीय नागरिक होने का सबूत देने में नाकाम रहे हैं। हालांकि डॉक्टर हजेला ने इस बात का सख़्ती से खंडन किया और उनके हवाले से ये ख़बर देने वाले रिपोर्टर के ख़िलाफ़ केस दर्ज करने की चेतावनी भी दी। डॉक्टर प्रदीप हजेला ने कहा कि राज्य में अवैध रूप से रह रहे लोगों की संख्या महज़ 50 हज़ार के आस-पास है।
भारत-बांग्लादेश के बीच कोई समझौता नहीं
सवाल ये है कि उन लोगों का क्या होगा जिन्हें 'विदेशी' ठहराया जाएगा? अब चूंकि भारत और बांग्लादेश की सरकारों के बीच विदेशी बांग्लादेशी ठहराए गए लोगों को वापस भेजने का कोई समझौता नहीं है, तो उन लोगों का क्या होगा जो कई पीढ़ियों से भारत को अपना देश मानकर यहां रह रहे हैं?
सरकार की तरफ़ से इस बात का कोई साफ़ जवाब नहीं आया है। असम के मंत्री और बीजेपी नेता हिमंता बिस्वा शर्मा ने दिसंबर में कहा था कि नागरिकता के नेशनल रजिस्टर को तैयार करने का मक़सद, ''असम में अवैध रूप से रह रहे बांग्लादेशियों की शिनाख़्त करना है। इन्हें वापस बांग्लादेश भेजा जाएगा।'' हिमंता बिस्वा शर्मा ने आगे कहा कि 'बंगाली बोलने वाले हिंदू' असमिया लोगों के साथ ही रहेंगे। ये बयान बीजेपी की विचारधारा से मिलता-जुलता है।
केंद्र सरकार ने हर हिंदू को भारतीय होने का नैसर्गिक अधिकार देने का एक क़ानून भी पेश किया था। लेकिन, असम के ज़्यादातर नागरिक ऐसी किसी भी रियायत के ख़िलाफ़ हैं।

जिन लोगों को विदेशी मान लिया जाएगा उनका क्या होगा, इसका अंदाज़ा हम उन लोगों के हालात से लगा सकते हैं जिन्हें असम के फ़ॉरेनर्स ट्राईब्यूनल ने विदेशी ठहराया है। इनमें मर्द भी हैं और महिलाएं भी। विदेशी ठहराए गए इन लोगों को राज्य की जेलों में ही बनाए गए नज़रबंदी शिविरों में रखा गया है। इनमें से कई तो ऐसे हैं जो पिछले एक दशक से क़ैद हैं। इनकी रिहाई की कोई उम्मीद भी नहीं दिखती।
इन नज़रबंदी शिविरों में मानवाधिकार संगठनों और मानवतावादी कार्यकर्ताओं के जाने की मनाही है। इसलिए इन शिविरों में क़ैद लोगों के हालात कभी आम लोगों की नज़र में नहीं आते। पिछले साल मैंने राष्ट्रीय मानवाधिकार आयोग के अल्पसंख्यकों के विशेष निरीक्षक बनने के आमंत्रण को स्वीकार किया था। इसके बाद अपने सबसे पहले मिशन के तहत मैंने असम के इन नज़रबंदी शिविरों के दौरे की इजाज़त मांगी थी।
मैं इस मक़सद से 22 जनवरी से 24 जनवरी के बीच असम के दौरे पर गया। मैंने गोलपाड़ा और कोकराझार में बने अवैध विदेशी नागरिकों के नज़रबंदी शिविरों का दौरा किया। मैंने यहां क़ैद लोगों से लंबी बातचीत की। मैंने पाया कि ये नज़रबंदी शिविर मानवीय सिद्धांतों के लिहाज़ से और क़ानूनी पहलू से भी एक काली, डरावनी तस्वीर पेश करते हैं।
मेरे बार-बार याद दिलाने के बावजूद, न तो मानवाधिकार आयोग और न ही केंद्र या राज्य सरकार ने मुझे ये बताया कि इन नज़रबंदी शिविरों को लेकर मेरी रिपोर्ट पर क्या कार्रवाई हुई। और अब जबकि राष्ट्रीय नागरिकता रजिस्टर की प्रक्रिया पूरी होने के बाद लाखों लोगों को विदेशी ठहराए जाने का डर है, तो मेरे सामने एक ही रास्ता बचता है कि मैं राष्ट्रीय मानवाधिकार आयोग के अल्पसंख्यकों के विशेष निरीक्षक के पद से इस्तीफ़ा दे दूं और असम के नज़रबंदी शिविरों के हालात पर अपनी रिपोर्ट जनता के सामने रखूं।
क़ानूनी मदद मुहैया नहीं
इन नज़रबंदी शिविरों में क़ैद अवैध विदेशी घोषित किए गए ज़्यादातर लोगों को बुनियादी क़ानूनी मदद तक नहीं मुहैया कराई गई है। न ही फ़ॉरेनर्स ट्राइब्यूनल ने इनका पक्ष सुना है। इन में से ज़्यादातर लोगों को ट्राइब्यूनल के आदेश पर नज़रबंद किया गया क्योंकि वो ट्राइब्यूनल के बार-बार बुलाने के क़ानूनी नोटिस जारी किए जाने के बावजूद उसके सामने पेश नहीं हुए थे। हालांकि नज़रबंद लोगों में से ज़्यादातर ने कहा कि उन्हें तो नोटिस मिले ही नहीं।
एक मानवतावादी लोकतंत्र होने के नाते हम बलात्कार और हत्या जैसे गंभीर अपराध करने वालों को भी बचाव के लिए क़ानूनी मदद मुहैया कराते हैं। लेकिन इन अवैध विदेशी नागरिकों के मामले में बिना अपराध किए ही ये लोग इसलिए नज़रबंदी शिविरों में सड़ रहे हैं क्योंकि वो क़ानूनी लड़ाई नहीं लड़ सकते।
इन लोगों के लिए बनाए गए नज़रबंदी शिविरों को जेलों के ही एक हिस्से में बनाया गया है। यहां कई क़ैदी बरसों से बंधक बनाकर रखे गए हैं। न इनके पास कोई काम है, न दिल बहलाने का कोई ज़रिया। इनके पास अपने परिजनों से संपर्क करने का भी कोई ज़रिया नहीं। कभी-कभार इक्का-दुक्का रिश्तेदार इनसे मिलने आ जाते हैं। इनकी रिहाई की कोई उम्मीद नज़र नहीं आती।
जेल में किसी क़ैदी को कम से कम टहलने, काम करने और खुले में आराम करने की आज़ादी तो होती है, लेकिन इन नज़रबंद लोगों को तो दिन में भी बैरक से बाहर निकलने की इजाज़त नहीं है क्योंकि उन्हें तो आम नागरिक क़ैदियों से नहीं घुलने-मिलने दिया जाना चाहिए।

बच्चों को परिवारों से अलग रखा गया
हमने पाया था कि मर्द और औरतें और छह साल से ज़्यादा उम्र के बच्चे अपने परिवारों से अलग करके रखे गए थे। इससे उनकी परेशानी और बढ़ गई थी। कई लोग अपने जीवनसाथी से कई सालों से नहीं मिले।
इनमें से कई तो ऐसे हैं जो नज़रबंद होने के बाद से एक बार भी अपने जीवनसाथी से नहीं मिले। क़ानूनी तौर पर ये क़ैदी अपने परिवारों से नहीं मिल सकते हैं। लेकिन, कभी-कभार जेल के अधिकारी इन लोगों को इंसानियत की बिनाह पर अपने मोबाइल फ़ोन से परिजनों से बात करा देते हैं। इन लोगों को परिजनों की बीमारी या मौत पर भी परोल नहीं दिया जाता। उनकी समझ से परोल पर किसी सज़ायाफ़्ता क़ैदी का ही हक़ है क्योंकि वो भारतीय नागरिक हैं।
मानवाधिकार आयोग को मेरा सब से अहम सुझाव ये था कि इन लोगों के हालात को सबसे पहले तो संविधान की धारा 21 और अंतरराष्ट्रीय क़ानून के हिसाब से वैधानिकता के दायरे में लाने की व्यवस्था करनी चाहिए। उन्हें आम अपराधियों के साथ जेल परिसर में बिना सुविधाओं और क़ानूनी नुमाइंदगी के क़ैद कर के रखना, परिजनों से संवाद न करने देना, उनके सम्मान से जीने और क़ानूनी प्रक्रिया के अधिकार का उल्लंघन है।
अंतरराष्ट्रीय क़ानून साफ़ कहता है कि अप्रवासियों को जेल में बंद कर के नहीं रखा जा सकता। उन्हें अपराधी की तरह नहीं रखा जा सकता। मानवता के सिद्धांत और अंतरराष्ट्रीय क़ानूनों के मुताबिक़ अवैध अप्रवासियों को उनके परिवारों से किसी भी सूरत में अलग नहीं किया जाना चाहिए।
इस नियम का मतलब ये है कि अवैध रूप से रह रहे लोगों को खुले नज़रबंदी शिविरों में रखा जाना चाहिए, न कि जेलों में क़ैद किया जाना चाहिए। ऐसे लोगों को अनिश्चित काल के लिए क़ैद में रखना संविधान की धारा 21 और अंतरराष्ट्रीय मानवाधिकारों के पैमानों का उल्लंघन है। संविधान से मिलने वाला जीने का बुनियादी हक़ केवल भारतीय नागरिकों को ही नहीं, बल्कि उन लोगों को भी हासिल है जिनकी नागरिकता शक के दायरे में है।
विदेशी ठहराए गए लोगों से भारत का सलूक संवैधानिक नैतिकता के साथ-साथ राष्ट्रीय और अंतरराष्ट्रीय क़ानूनों के दायरे में होना चाहिए। अवैध अप्रवासियों के प्रति हमारा बर्ताव हमदर्दी भरा होना चाहिए। इन औरतों, बच्चों और मर्दों को मुजरिमों से भी बुरे हालात में अनिश्चित काल के लिए क़ैद कर के सिर्फ़ इसलिए रखना क्योंकि वो अपनी नागरिकता साबित नहीं कर सके (या उन्हें साबित करने का मौक़ा नहीं दिया गया), न केवल भारत की सरकार की छवि पर धब्बा है, बल्कि इसके नागरिकों के लिए भी शर्मनाक है।
