क्या 'अडल्ट्री क़ानून' में बदलाव से शादियां ख़तरे में पड़ जाएंगी?

अडल्ट्री यानी व्याभिचार, यह शब्द एक बार फिर चर्चा में है. सरकार ने सुप्रीम कोर्ट में दायर की गई एक याचिका पर अपना पक्ष रखते हुए कहा है कि अडल्ट्री से जुड़े क़ानून को हल्का करने या उसमें बदलाव करने से देश में शादी जैसी संस्था ख़तरे में पड़ सकती है।

इटली में रहने वाले एनआरआई जोसेफ़ शाइन ने सुप्रीम कोर्ट में इस संबंध में एक याचिका दायर की थी। उन्होंने अपील की थी कि आईपीसी की धारा 497 के तहत जो अडल्ट्री क़ानून है उसमें पुरुष और महिला दोनों को ही बराबर सज़ा मिलनी चाहिए। इस याचिका के जवाब में सरकार ने सुप्रीम कोर्ट में कहा है कि अगर इस क़ानून में बदलाव कर पुरुष और महिला दोनों को सज़ा का प्रावधान किया जाता है तो इससे अडल्ट्री क़ानून हल्का हो जाएगा और समाज पर इसका बुरा प्रभाव पड़ेगा।

क्या है अडल्ट्री क़ानून?

सबसे पहले अडल्ट्री क़ानून को समझते हैं कि आखिर क़ानूनी भाषा में इसके मायने क्या हैं। 1860 में बना यह क़ानून लगभग 150 साल पुराना है। आईपीसी की धारा 497 के तहत इसे परिभाषित किया गया है।

अगर एक शादीशुदा मर्द किसी दूसरी शादीशुदा औरत के साथ उसकी सहमति से शारीरिक संबंध बनाता है, तो पति की शिकायत पर इस मामले में पुरुष को अडल्ट्री क़ानून के तहत गुनहगार माना जाता है। ऐसा करने पर पुरुष को पांच साल की क़ैद और जुर्माना या फिर दोनों ही सज़ा का प्रवाधान है। हालांकि इस क़ानून में एक पेच यह है कि अगर कोई शादीशुदा मर्द किसी कुंवारी या विधवा औरत से शारीरिक संबंध बनाता है तो वह अडल्ट्री के तहत दोषी नहीं माना जाएगा।

क़ानून पर मतभेद

हालांकि यह अपने आप में काफ़ी विवादित विषय है कि जब दो वयस्कों की मर्जी से कोई विवाहेतर संबंध स्थापित किए जाते हैं तो इसके परिणाम में महज़ एक पक्ष को ही सज़ा क्यों दी जाए? विशेष तौर से पुरुष इस क़ानून पर आपत्ति दर्ज करवाते हैं।

चंडीगढ़ के पीजीआई अस्पताल में कार्यरत नवीन कुमार की शादी दो साल पहले ही हुई है। उनकी पत्नी बिहार में रहती हैं। नवीन का मानना है कि यह क़ानून पूरी तरह ग़लत है। अगर कोई दो शादीशुदा पुरुष और महिला एक साथ सहमति से विवाहेतर संबंध बना रहे हैं और क़ानूनन यह ग़लत है तो इसकी सज़ा भी दोनों को ही मिलनी चाहिए।

नवीन कहते हैं, ''अगर किसी को सिर्फ़ महिला होने की वजह से छोड़ दिया जाता है तो यह बिलकुल ग़लत है, क्योंकि जो भी महिला विवाहेतर संबंध बनाएगी वह इतनी समझदार होगी ही कि अपना भला-बुरा समझ सके। इसलिए अगर कुछ गैरक़ानूनी है तो उसकी सज़ा भी दोनों की दी जाए।''

वहीं महिलाओं के भी अपने तर्क हैं। तोशी शंकर ने बीबीसी हिंदी के महिलाओं से जुड़े एक ग्रुप में इस विषय पर अपनी राय रखी है।

तोशी लिखती हैं, ''मुझे बड़ा दिलचस्प लगता है जब न्यायिक प्रक्रिया बराबरी की बात करती है लेकिन वहां पर कितनी विसंगतियां हैं इस पर बात नहीं करती। अडल्ट्री क़ानून में पुरुष और महिला दोनों को सज़ा देने पर उन महिलाओं को क़ानूनी पचड़े में डालना कितना आसान हो जाएगा जो बुरी शादियों में हैं और बाहर प्रेम ढूंढ़ती हैं।''

हालांकि तोशी मानती हैं कि बुरी शादियों में फंसना और बाहर प्रेम तलाशने जैसी नौबत पुरुषों के सामने भी आ सकती है लेकिन मौजूदा वक्त में तो यह मामले महिलाओं के साथ ही ज़्यादा होते हैं। फ़िलहाल जोसेफ़ शाइन की इस याचिका पर सुप्रीम कोर्ट की संवैधानिक पीठ सुनवाई कर रही है।

इसी साल पांच जनवरी को ये मामला सुप्रीम कोर्ट पहुंचा था, जब चीफ़ जस्टिस दीपक मिश्रा की अध्यक्षता वाली सुप्रीम कोर्ट की एक बेंच ने इस जनहित याचिका को संवैधानिक बेंच के पास भेज दिया था। इस याचिका पर संवैधानिक पीठ का फ़ैसला आना बाक़ी है।

ऐसा भी नहीं है कि अडल्ट्री पर पहली बार सवाल उठाए गए हों, इससे पहले 1954, 1985 और 1988 में भी अडल्ट्री पर सवाल पूछे गए थे। पिछले साल भी सुप्रीम कोर्ट ने एक याचिका पर सुनवाई करते हुए पूछा था कि सिर्फ़ पुरुष को गुनहगार मानने वाला अडल्ट्री क़ानून पुराना तो नहीं हो गया है?

वहीं 1954 और 2011 में दो बार इस मामले पर फ़ैसला भी सुनाया जा चुका है, जिसमें इस क़ानून को समानता के अधिकार का उल्लंघन करने वाला नहीं माना गया।
