શાસક ભારતીય જનતા પક્ષ (ભાજપ)ની ઇચ્છા છે કે 'એક રાષ્ટ્ર, એક ચૂંટણી'નો વિચાર વાસ્તવિક બને. જોકે, આ માટેની દરખાસ્ત રાજકીય વધારે છે, વ્યવહારુ ઓછી છે. આ દરખાસ્તનું વિશ્લેષણ અહીં આપ્યું છે.

આકર્ષક પણ ગેરમાર્ગે દોરનારું સૂત્ર 'એક રાષ્ટ્ર, એક ચૂંટણી' આજકાલ લોકપ્રિય બની રહ્યું છે. હકીકતમાં આજે પણ દેશમાં એક જ ચૂંટણી, લોકસભાની એક જ ચૂંટણી થાય છે, એટલે આ સૂત્ર ગેરમાર્ગે દોરનારું છે. છ દાયકા કરતાં વધુ સમય પહેલાં દેશે ચૂંટણી આધારિત લોકતંત્રની દિશામાં કદમ માંડ્યા હતાં. આમ છતાં એક વર્ગ ચૂંટણી પ્રક્રિયા સામે શંકા વ્યક્ત કરતો રહ્યો છે. એક યા બીજા બહાને આ વર્ગ ચૂંટણી સામે ફરિયાદો કર્યા કરે છે અને આ વખતે આ સૂત્રને કારણે તે વર્ગને ફરી તક મળી ગઈ છે.

નરેન્દ્ર મોદીએ 2014માં એવી દરખાસ્ત મૂકી હતી કે બધી જ ચૂંટણીઓ એક સાથે થઈ જવી જોઈએ. તે પછીથી રાબેતા મુજબ ચૂંટણી પ્રક્રિયા સામેની ફરિયાદો વ્યક્ત થતી રહી છે - કે ચૂંટણીઓ બહુ મોંઘી છે, તેના કારણે સરકારના નીતિ-નિર્ધારણ કાર્યમાં અવરોધ આવે છે. આ દરખાસ્ત લોકસભા અને રાજ્યોની વિધાનસભાની ચૂંટણીઓ એકસાથે યોજવાની છે. કેટલાક મુખ્ય પ્રધાનો વળી પોતાનું એવું ડહાપણ ડહોળી રહ્યા છે કે સાથેસાથે પંચાયતોની ચૂંટણી પણ કરી નાખવી જોઈએ.

દેશને આઝાદી મળી તે પછી કેન્દ્રમાં તથા રાજ્યોમાં ધારાગૃહોની રચના કરવા માટે પુખ્તવયે સાર્વત્રિક મતાધિકારના આધારે ચૂંટણીઓ કરાવવી જરૂરી હતી. તેથી 1951-52 દરમિયાન પ્રથમ લોકસભા ચૂંટણી યોજાઈ હતી. તેની સાથે રાજ્યોની વિધાનસભાઓની ચૂંટણીઓ પણ યોજાઈ હતી. આપણા બંધારણ પ્રમાણે કોઈ પણ ગૃહની મુદત પાંચ વર્ષની હોય છે. જોકે, રાજ્યોના મુખ્ય પ્રધાનો અથવા કેન્દ્રમાં વડા પ્રધાન ગૃહને વિખેરી નાખવાની ભલામણ કરી શકે છે. મુદત પૂર્ણ થયા પહેલાં અવિશ્વાસનો ઠરાવ પસાર થાય અને બીજી કોઈ સરકારની રચના ના થઈ શકે ત્યારે પણ ગૃહને વિખેરી નાખવામાં આવે છે અને નવેસરથી ચૂંટણી યોજવામાં આવે છે.

એકસાથે ચૂંટણીનો આગ્રહ શા માટે?

1952 પછી ધારાગૃહો ભંગ થવાની ઘટનાઓ ભાગ્યે જ બની હતી. તેથી 1967માં ચોથી વાર લોકસભા ચૂંટણી યોજાઈ ત્યારે સાથેસાથે રાજ્યોમાં પણ ચૂંટણીઓ યોજાઈ હતી. જોકે, કેન્દ્રની અને રાજ્યોની ચૂંટણીઓ એક સાથે કરવી તેવી કોઈ બંધારણીય જોગવાઈ નથી. એ માત્ર યોગાનુયોગ રહ્યો કે 1967 સુધી ચૂંટણીઓ સાથેસાથે થતી રહી. 1967માં લોકસભામાં કૉંગ્રેસને ચોથી વાર બહુમતી મળી હતી, પરંતુ ઘણાં રાજ્યોમાં તેની હાર થઈ હતી.

જોકે, આ રાજ્યોમાં કૉંગ્રેસનો કોઈ એક મજબૂત હરીફ પક્ષ નહોતો, તેના કારણે કોઈ એક પક્ષને સરકાર રચવા જેટલી બહુમતી મળી હોય તેવું બન્યું નહોતું. જેથી જોડાણનું રાજકારણ શરૂ થયું અને રાજ્ય સરકારો અસ્થિર બનવા લાગી. કેટલાંક રાજ્યોમાં ગૃહની મુદત પૂરી થાય તે પહેલાં જ ફરીથી ચૂંટણી કરવી પડી. જેના લીધે એક સાથે ચૂંટણીઓ થતી હતી તે ક્રમ તૂટ્યો. એટલું જ નહીં, ઇન્દિરા ગાંધીએ 1972માં યોજાનારી લોકસભાની ચૂંટણીને એક વર્ષ વહેલી જાહેર કરી દીધી, તેના કારણે પણ ક્રમ વિખેરાઈ ગયો. તેમાં વધુ એકવાર વિઘ્ન આવ્યું, કેમ કે કટોકટી લાદવામાં આવી અને લોકતાંત્રિક પ્રણાલીઓ તોડવામાં આવી.

તે પછીની લોકસભાની ચૂંટણી 1977માં યોજાઈ પણ કેન્દ્ર અને રાજ્ય સરકારોની ચૂંટણી વચ્ચે ગાળો વધ્યો. 1990ના દાયકામાં એકથી વધુ વાર લોકસભાને પણ મુદત પહેલાં વિખેરી નાખવી પડી અને મધ્ય સત્ર ચૂંટણીઓ આવી પડી. કેટલાંક રાજ્યોમાં પણ મધ્ય સત્ર ચૂંટણીઓ કરવી પડી હતી. છેલ્લા કેટલાક વખતથી એવું થઈ રહ્યું છે કે માત્ર આંધ્ર પ્રદેશ, અરૂણાચલ પ્રદેશ અને ઓડિશાની ચૂંટણી જ લોકસભાની ચૂંટણી સાથે થઈ રહી છે. હવે દર વર્ષે ત્રણ કે ચાર રાજ્યોની ચૂંટણીઓ આવ્યા જ કરે છે. 'એક રાષ્ટ્ર, એક ચૂંટણી'ના તરફદારોની બે મુખ્ય માગણી છે - એક, મધ્ય સત્ર ચૂંટણી કરવાની વાત એક જાતનો બોજ છે, તેથી દર પાંચ વર્ષે જ ચૂંટણી થવી જોઈએ. બીજું, લોકસભા અને વિધાનસભાઓની ચૂંટણીઓ એક સાથે જ થવી જોઈએ.

આ માગણીઓના સમર્થનમાં અપાતાં કારણોને હવે તપાસીએ.

ઓછો ખર્ચ

વારેવારે થતી (અને મધ્ય સત્રમાં થતી) ચૂંટણીઓ ભારે ખર્ચાળ છે. તેથી ચોક્કસ સમયગાળે જ ચૂંટણીઓ યોજાવી જોઈએ. અહીં 'ખર્ચાળ' કયા અર્થમાં છે તે સમજી લેવાની જરૂર છે. ચૂંટણી માટે ખર્ચ કરવાની વાત બિનજરૂરી છે અને આપણી પાસે વિકલ્પ નથી માટે કરવો પડે છે તેમ માનનારા માટે, ગમે તેટલો ઓછો ખર્ચ પણ 'ખર્ચાળ' જ ગણાશે. ખર્ચ અંગેની દલીલ આપણે સ્વીકારી લઈશું તો સાર એ નીકળશે કે શક્ય હોય ત્યાં સુધી ચૂંટણી કરવી જ નહીં અથવા ઓછામાં ઓછી ચૂંટણીઓ કરવી.

ચૂંટણીમાં ખરેખર કેટલો ખર્ચ થાય છે?

પ્રાથમિક અંદાજ અનુસાર 2014ની ચૂંટણીમાં 3426 કરોડ રૂપિયાનો ખર્ચ થયો હતો. આટલો ખર્ચ જોઈને આપણે ચિંતા થાય, પણ આટલો મોટો ખર્ચ મતદારોની સંખ્યા વડે ભાગીએ તો કેવું ચિત્ર મળે છે?

2014ના નોંધાયેલા મતદારોની સંખ્યાને ધ્યાનમાં રાખીને ગણતરી કરીએ તો માથાદીઠ માત્ર 42 રૂપિયાનો જ ખર્ચ થયો અને તે પણ પાંચ વર્ષે એકવાર. 2014ના કેન્દ્રના બજેટમાં એક વર્ષ માટે કુલ 17,94,892 કરોડ રૂપિયાની જોગવાઈ કરાઈ હતી.

એ આંકડાં સામે દર પાંચ વર્ષે ચૂંટણી પાછળ થતો ખર્ચ વધારે પડતો ગણાય ખરો?

બીજું, કેન્દ્ર અને રાજ્યોની ચૂંટણીઓ સાથે યોજાશે ત્યારે પણ વીવીપેટ વગેરે માટેનો ખર્ચ અલગઅલગ જ કરવાનો રહેશે.

માત્ર સલામતી વ્યવસ્થા અને ચૂંટણી તંત્ર પાછળનો સરેરાશ ખર્ચ જ એકસમાન રહેશે. તેથી ચૂંટણી ખર્ચની દલીલમાં કંઈ દમ નથી, કેમ કે તેમાં મામૂલી બચત જ થવાની છે.

નીતિ નિર્ધારણમાં અવરોધ?

બીજી દલીલ એવી કરવામાં આવે છે કે સતત ચૂંટણીઓ આવતી રહે છે, તેના કારણે લોકહિત માટે નીતિ નિર્ધારણમાં અવરોધ આવે છે. આચારસંહિતાને કારણે કાર્યો અટકી પડે છે. આ આચારસંહિતાની બાબતમાં નાહકનો વધારે વિરોધ કરવામાં આવી રહ્યો છે. આચારસંહિતા પ્રમાણે ચૂંટણીની તારીખો જાહેર થઈ જાય તે પછી મતદારોને પ્રભાવિત કરી શકે તેવી કોઈ નીતિની જાહેરાત કરી શકાતી નથી. વાર્ષિક બજેટ રજૂ થઈ જાય તે પછી સરકારને શા માટે નીતિ વિષયક નિર્ણયો વચ્ચેના સમયમાં જાહેર કરવાની જરૂર પડવી જોઈએ?

ચૂંટણી ક્યારે આવશે તેની સંભવિત તારીખોની સૌને ખબર જ હોય છે. દરેક રાજકીય પક્ષને એ ખબર જ હોય છે કે આચારસંહિતા લાગુ પડે તે પહેલાં કેવી રીતે જાહેરાતો કરી શકાય. તેથી આચારસંહિતાના નડતરની દલીલ પણ ચાલી શકે તેવી નથી. મહત્ત્વની વાત એ છે કે શાસક અને વિપક્ષ બધા જ રાજકીય પક્ષોની એ જવાબદારી બને છે કે સર્વસંમતિ સાથે એવા નિયમો બને કે સરકાર સત્તાનો દુરુપયોગ ના કરી શકે. રાજકીય પક્ષો એવું કરી શકતા નથી, તેથી આપણે ચૂંટણીની પ્રક્રિયા બદલવી જોઈએ તે વાત મચ્છરો મારવા માટે તોપમારો કરવા જેવી છે.

સતત ચૂંટણી પ્રચારનું દબાણ

એકસાથે ચૂંટણી કરાવી લેવાની તરફેણમાં એક દલીલ એવી થાય છે કે વડા પ્રધાન, પ્રધાનો, રાજકીય પક્ષોના સિનિયર નેતાઓ પર સતત ચૂંટણી પ્રચારનું દબાણ રહે છે. સતત પ્રચારના કારણે સરકારમાં કરવાના હોય તે કામમાં, રાબેતા મુજબના રાજકીય કાર્યોમાં, સરકારી કામગીરીના મૂલ્યાંકનમાં, ગૃહોની કામગીરીમાં અવરોધ આવે છે. આ દલીલો બહુ જોરદાર છે. પણ તેમાં એક મોટી ખામી છે.

વડા પ્રધાન કે તેમના પ્રધાનો અથવા રાજકીય પક્ષોના વડાઓ રાજ્યોની ચૂંટણીમાં પણ વધારે પડતો સમય આપતો હોય તો તેમાં તેમનો પક્ષના હિતને જ ધ્યાનમાં રાખવાનો અભિગમ છતો થાય છે.

ઠીક છે, આ દલીલ અમુક હદે માન્ય રહી શકે, પણ તેમાં માત્ર જે રાજ્યમાં ચૂંટણી હોય અને તે રાજ્યમાં જે પક્ષો વચ્ચે મુખ્ય સ્પર્ધા હોય તેના માટે જ દબાણ હોય છે. ઘણી વાર દબાણ માત્ર રાષ્ટ્રીય પક્ષોને વધારે હોય છે, બધા પ્રાદેશિક પક્ષો પર દબાણ હોતું નથી.

દેશમાં આજે બે મુખ્ય રાષ્ટ્રીય પક્ષો કોંગ્રેસ અને ભાજપ છે, જે સાચા અર્થમાં દેશભરમાં ક્યાંય પણ યોજાતી ચૂંટણીમાં સક્રિય હોય.

બાકીના પ્રાદેશિક પક્ષોને માત્ર પોતાના રાજ્યની ચૂંટણી પૂરતી જ ચિંતા હોય છે. તો શું એવો અર્થ કાઢવો કે એક સાથે ચૂંટણી કરવાથી માત્ર આ બે મુખ્ય પક્ષોને જ પ્રાદેશિક પક્ષો સામેની સ્પર્ધામાં ફાયદો થવાનો છે?એક સાથે ચૂંટણી કરવા માટે જે કાર્યવાહી કરવી પડશે, તેમાંથી એવી કઈ બાબત છે જેના કારણે આ વાતને વ્યવહારુ ના ગણી શકાય?

પ્રથમ તો લોકસભા અને રાજ્યોની વિધાનસભાની મુદત પાંચ વર્ષ માટે નિશ્ચિત કરી દેવાની જરૂર પડશે.

આડકતરી રીતે તેનો અર્થ થયો કે અવિશ્વાસની દરખાસ્ત લાવવાનો કે ગૃહને મુદત પહેલાં વિખેરી નાખવાનો માર્ગ બંધ થઈ જશે.

આ દરખાસ્તમાં શું છે?

નીતી આયોગે આ મુદ્દાના સ્પષ્ટીકરણ માટે નોંધ તૈયાર કરી છે. તેમાં નીચે પ્રમાણેના મુદ્દાઓને ટાંકવામાં આવ્યા છેઃ

અવિશ્વાસનો ઠરાવ ગૃહમાં રજૂ કરવામાં આવે ત્યારે નવી સરકારની રચના માટેનો વિશ્વાસનો ઠરાવ પણ સાથે મૂકવાની જોગવાઈ હોવી જોઈએ. કોઈ પણ કારણસર રાજ્યમાં એવી સ્થિતિ આવી પડે કે સરકારની રચના થઈ શકે તેમ ના હોય, ત્યારે બાકીની મુદત માટે રાષ્ટ્રપતિનું શાસન દાખલ કરવું. રાજ્યમાં કોઈ સરકાર વહેલી પડી ભાંગે, ત્યારે નવા ગૃહ માટે ચૂંટણી યોજાવી જોઈએ, પણ તેની મુદત પાંચ વર્ષના બદલે માત્ર બાકી રહેતા સમયગાળા માટેની જ હોવી જોઈએ. આ ગાંડપણભરી લાગતી દરખાસ્તને લાગુ કરવા માટે બંધારણમાં ઘણા બધા સુધારા કરવા પડશે.

કટોકટી વખતે બંધારણનો 42મો સુધારો કરાયો હતો તેના જેવા આ બંધારણીય સુધારા હશે. તેની લાંબા ગાળાની અસરો પડશે. તેના કારણે બંધારણનો મૂળભૂત ઢાંચો બદલાઈ જશે અને સુપ્રીમ કોર્ટે કેશવાનંદ ભારતી કેસમાં આપેલા ચુકાદાનો પણ ભંગ થશે.

ફાયદો કોને છે?

એકસાથે ચૂંટણીથી દેશને કોઈ ફાયદો થવાનો નથી. તેના કારણે ચૂંટણી પ્રક્રિયા વિશુદ્ધ બનશે અને લોકહિતવાળી સરકાર આવશે એવું પણ થવાનું નથી. તેનાથી ઉલટું દેશની તંદુરસ્ત લોકતાંત્રિક પ્રણાલી પર અસર પડશે. અગાઉ કહ્યું તે પ્રમાણે આ પગલાનો ફાયદો માત્ર મોટા અને રાષ્ટ્રીય પક્ષોને જ છે. કેન્દ્રમાં રહેલો શાસક પક્ષ રાજ્યોમાં પણ પોતાની સરકારો બનાવીને વધારે ફાયદો મેળવવાની કોશિશ કરશે.

1989 અને 2014માં લોકસભા સાથે જે રાજ્યોમાં વિધાનસભાની ચૂંટણીઓ યોજાઈ હતી, તેમાં જોવા મળ્યું હતું કે લોકસભામાં બહુમતી મેળવનાર પક્ષને રાજ્યોની ચૂંટણીમાં પણ ફાયદો થયો હતો. દાખલા તરીકે પ્રવીણ ચક્રવર્તીએ (ધ હિન્દુ, 6 એપ્રિલ, 2016) નોંધ્યું હતું તે પ્રમાણે છેલ્લાં 25 વર્ષોમાં કેન્દ્રની ચૂંટણી સાથે જ રાજ્યોની વિધાનસભાઓની ચૂંટણી થઈ હોય ત્યારે 77 ટકા રાજ્યોમાં એક જ પક્ષ વિજેતા બન્યો હતો.

જયદીપ છોકર અને સંજય કુમારે (ધ હિન્દુ, 27 સપ્ટેમ્બર, 2016) નોંધ્યું હતું તેમ છેલ્લાં 25 વર્ષોમાં 31 વાર લોકસભા અને વિધાનસભાઓની ચૂંટણીઓ એક સાથે યોજાઈ હતી. તેમાંથી 24 વાર એવું બન્યું હતું કે મોટા પક્ષોને બંને ચૂંટણીમાં લગભગ એકસમાન મતો મળ્યા હતા. તેનો અર્થ એ થયો કે એકસાથે ચૂંટણીઓ યોજવામાં આવે ત્યારે રાજ્યકક્ષાએ અલગથી નિર્ણય લેવાની લોકોની સ્વતંત્રતા ઘણા અંશે છીનવાઈ જશે.

આવી સ્થિતિ દેશના સંઘીય ઢાંચા માટે હિતકારક નથી તે સામાન્ય નાગરિક પણ સમજી શકશે.

1989થી દેશમાં રાજકીય પક્ષોના રાજકારણનું પણ સંઘીયકરણ થયું છે, જેની નોંધ મોટા ભાગના વિદ્વાનોએ લીધી છે. જો એકસાથે ચૂંટણીઓ યોજવામાં આવશે તો દેશના રાજકારણના સંઘીય ઢાંચાનું દૃઢ બનવાનું અટકી જશે. તેના કારણે રાજકીય સ્પર્ધા વધારે ને વધારે કેન્દ્રવર્તી થતી જશે. આ દરખાસ્ત નાના, પ્રાદેશિક પક્ષોના હિતોની વિરુદ્ધ છે અને તેના કારણે લોકતંત્રની ગાડી અવળા પાટે ચડી જશે. તેના કારણે બંધારણમાં એવા ફેરફારો થશે જે સંસદીય માળખાને પણ અસર કરશે.

આ દરખાસ્ત વાસ્તવમાં અમલી બને તે માટે હજી ઘણો સમય લાગી શકે છે. જે રીતે વર્તમાન સરકાર તેના માટે આગ્રહ રાખી રહી છે અને તેના પર પરાણે ચર્ચા જગાવવાની કોશિશ કરી રહી છે, તેને કારણે કેટલાક સવાલ થાય છે. આ પ્રયાસો આપણને એવા તારણ પર લાવી રહ્યા છે કે બંધારણના મૂળભૂત ઢાંચા વિશે દુવિધા ઊભા કરવા માટેના પ્રયાસો તમામ સ્તર પર ઇરાદાપૂર્વક કરવામાં આવી રહ્યા છે.

નાગરિકોને જવાબદાર સરકાર આપતી સંસદીય પદ્ધતિ વિશે પણ દુવિધાઓ ઊભી કરવા માટેના પ્રયાસો થઈ રહ્યાનું તારણ નીકળે છે.
